Legislative Hearing Hostile To Citizens

Dear Ms. Moermond,
My husband and I just received evaluation forms relativeto our experiences with the
legislative hearing process last MayIJune. Copies of the Completed forms are attached,
but we feel the subject needs additional information and emphasis. Also attached are
the correction notice that started the process and my letter of 5/25/04 outlining my
mother's (Mildred Nieszner) situation.
Since that time, Mildred's house has been sold to the Greater Frogtown CDC. At the
time of sale they were planning to rehab the house, but by closing they had decided it
would have to be torn down and Habitat would be building a new house in its place. a Mildred is currently at Abbott Northwestern Hospital recovering from major surgery.
We found several things about the legislative hearing process to be hostile to the
average citizen:
1) Filing an appeal -The notice said appeals had to be filed within seven days. The
letter was dated May lgth, but was not received until May 22", which was a Saturday.
This meant we had to file the appeal by Wednesday the 26'h, which gave us Monday
and Tuesday to contact the enforcing officer for information, obtain copies of the
necessary forms and instructions, write a letter and mail it in.
We called Ms. Seeley on Monday, but she did not return the call. It took a second call
on Tuesday for Ms. Seeley to call back - too late. Fortunately we also called the City
Clerk's Office on Monday and talked to Ms. Johnson, who was very helpful and faxed us
a copy of the forms.
It is clear to me that the city in not serious about appeals and is trying to discourage
them by making the deadline difficult to meet.
2) Legislative hearing -The staff was helpful in obtaining a workable time for us to
appear at the hearing on June 22nd. But, the hearing itself was a sham.
While everyone was formal and polite, it was clear to us they had already made up their
minds. Nobody cared a wit about Mildred's age, health, income or the other
complications of her life and ours. It seems the only purpose of the hearing was to
support the already-made decision of Ms. Seeley, the enforcement officer.

During the hearing we were offered some counsel regarding what avenues might be
available to us. The hearing officer especially pushed us to put the house in the Vacant
Building Program and told us this would be to Mildred's benefit. As we left the hearing
we had planned to pursue this approach. Upon further investigation, however, we
discovered the advice was not really in Mildred's best interest. We believe the advice to
be disingenuous, at best, and that it would have made her situation even more difficult.
All the hearing would allow is an extension of the compliance date from July 15'~to
September The initial timing only allowed 37 working days, with only 8 days
remaining at the time of the hearing. Adding another 42 days was still wholly
inadequate, given the Mildred's situation and ours, as her care givers.
At the end of the hearing they also made it vary clear that additional appeals were a
waste of time and effort.
We and Mildred have been life-long and contributing citizens of St. Paul. We can't
believe our home city would treat us in this callus and arbitrary manner.
3) Enforcement officer power - We are disturbed that a city employee has the power to
arbitrary disrupt the lives of average citizens without regard for their individual situations
and is protected in doing so by city government.
The house at 457 Charles has stood there since 1887. Its condition had been slowly
declining for many years as Mr. & Mrs. Nieszner aged and especially after Mr. Nieszner a died 3 years ago at 88 years old. Mildred (now 93) could not afford to do repairs on the
house. The family has been trying to get her to move into and elderly facility, at which
time we would be selling the house. So, in the natural course of things the repair of the
house would have resolved itself shortly, without city intervention.
In May Ms. Seeley, for some reason, decided to inspect the house and arbitrarily
decided it was critical that it be repaired and painted immediately. This is apparently
such a crisis that it overwhelms any consideration for the occupant's situation or the
amount of hardship or stress this command might create. When we attempted to
discuss this by phone, we found her callus, arbitrary and uncaring regarding Mildred's
situation.
I think the purpose of city government is to serve the people. I do not think the city
should give this kind of person this much power over everyday citizens. Automatically
confirming that power with a sham appeals process, makes it even more grievous.

That is a very sad story that shows once again the way the city of St.Paul has come to treat its long time citizens that have contributed most of their lives to the city. It is still beyond me how some of these heartless officials can actually go home and sleep at night, they appear to have no feelings for another human being whats so ever. I highly doubt this elderly woman caused any type of problems to the neighborhood, ever drive down Charles? It looks to me that the city saw this as another easy oppertunity to destroy ones life. Can you imagine the memories this elderly lady must of had of her home that the city destroyed and what effects this addtional stress must of had on her health. How can anyone be proud of this type of behavior from the city oifficials that one should actually be able to count on for help when needed? No help in St.Paul for the elderly or anyone else for that matter.... Stories like this one really hurt, we all have parents that are aging..

She is so far from this it is sick!! She is so one sided and siding with the city it is impossible to get a fair appeal. She also is very rude. She is not a pleasent person. By the way, is she an attorney? She seem's to think she knows everything. What qualifications does she have.
The city should hire an outside person who has distance from the city so the appealant has a fair shake.

The legislative hearing fficer is a city position. Whomever holds it, will be an employee of the city. Just like the city attorney. The qualifications are set by ordinance.

Everyone who doesn't get their thinks that its somehow slanted against them. It's not. You just either didn't have the correct information or do not have the correct information. There is an appeals process, that goes to the city council and we all know how nice you made it for yourselves with the city council.

The Hearing Officer was created by the City Council shortly after they became part time so that all of the problem properties wouldn't end up on the council agenda. There are many people who go to these hearings to ask for an additional 30-60 days and have repairs completed and routinely they get approved. It appears from the case sited above that the issue was that the home owners did not want an extention from the Hearing Officer but only wanted to have the issue dropped because the owner was very old.

The case could have been appealed but what was to have been appealed? The fact that the home owner was elderly should be an exemption from enforcement?

How do you win that one?

The Legislative Hearings are rigged, decided in advance, and anything but fair and unbiased. They are a sham just like the argument you put forth about going to the City Council. The City Council acts as a court so to speak, and the City Council members serve as the jury on that Court. That's your idea of fair. They are a body of people that hate landlords and they side with their "puppet" Hearing Officer 99% of the time.

This hearing officer should not be hearing anything to do with repairs on a property. She hasn't got a clue of what most repairs involve so how can she sit and decide if a repair is justified or if the time to do it is not long enough.

I have been to these Hearings and even when the Hearing Officer is presented clear and convincing evidence that the homeowner should win the appeal,, she makes some BS statement like "I don't appreciate being held over a barrel here," or she will tell you she will get back to you and she never does....instead rushing to the Council Hearing to finalize her decision. You may think she she is fine because she represents your little government empire where all you elites hang out. To the people who have suffered her decisions, she's nothing more than a NAZI nothing.

You will find out in the months to come how close to the NAZIs the city really is. Granted there are no furnaces yet, but some of these bureaucrats are eveything your imagination tells you about godless and evil people. This city had violated people civil rights in a wholesale scale for years. They have deliberately destroyed people's businesses and ran them out of town. When the city was sued they resorted to framing some people for criminal offenses as retaliation. They brought bogus civil lawsuits aginst property owners where no plaintiffs ever existed! They have applied strict and draconian standards to private landlords over petty crap while they looked the other way (and in some cases refused to take acton)not noly with their own PHA rental properties with serious problems, but also city employees properties with much worse violations.....and I am talking about a whole lot more than just the infamous Dave Thune property. They have not only hidden, but also changed official documents to aid in their denfense, they have fabricated false repairs and written repair notices to look the a persons property is a wreck when it is not. Many people have accused some city officials of trying to make them sell their property to associates of the city officials, and yet no one in the city refuses to hand the matter off to an outsider to investigate. Some inspectors have came to depositions and routinely lied...(not knowing the the Attorneys had already known the correct answers to the questions) in an effort to cover up the corruption. While the city uses the safety of the citizens as an issue to go after property owners with their illegal tactics, some inspectors come to depositions and say they don't give a damn about those people's sfatey because it is someone elses job! When the citizens don't like this type of behavior they are run through a Legislative Hearing process which is nothing but a sham and a fraud who's findings are upheld 7-0 by the same City Council that now wants to try and hide behind one of their crooked courts rather than come and tell the truth....all the while having brainwashed people like you sticking up for them and their illegal actions. Most people in this country and our city are sick and tired of government corruption and the little guy always getting screwed with no recourse 9:58, and in this city it is finaly going to be stopped. I think the word NAZI is quite appropriate for this style of leadership.

Well, yeah but what ya gonna do? The citizens of the city only hear that things are going to be prettied up and what's old will miraculously become new and crimefree. So why would anyone not effected by this even care?

Then you have idiots coming here, spending what must be countless hours a week, posting relalitory remarks. People who disguise themselves to look as though they have all the answers and knowledge of how wonderful things are. Their posts are so arrogant and at the same time ignorant, that it's all just too disgusting. It's unsavory to even read how so messed up in their thinking they are that they can even come up with the stupidity that they post here. I'd say everything is so messed up that the lid is about to blow and people and their kids are so sick of being pushed around that the Payne raper will be having like-minded company shortly.

It's really a shame because it was not like this even 6 short years ago. It's gonna get even worse!
