HEARING NOTICE
There will be a hearing in Federal Court to determine if the Plaintiffs in the Federal Lawsuit against the City of St. Paul will be allowed to take the Depositions of some of the City Council. Currently there is a protective order preventing these testimonies.
After taking many Depositions already, the City's own employees have testified under oath that these lawsuits against the City have merit.
The City of St. Paul has brought this court action in an attempt to help the City Council members and some of their employees to hide behind the court because they will feel annoyed and harassed.
We would like all of you to try and attend this hearing in the hopes that if the court sees that there are people from the community interested in this case and watching, then the court will be more likely to order the council members to submit to a Deposition and less likely to do something political.
We need to stop these cities from their illegal actions against landlords, and we need your help to do it. NHPI is right now in the process of "ramping up" their "Problem Property Unit" from 1 inspector to 5 inspectors. This coming summer is going to be hell for property owners. Minneapolis has just put together a "Problem Property Unit" that is similar to St. Pauls.
Please help us and come to the hearing next Monday January 22, 2007 at 1:30 P.M. in the afternoon.

After reading this blog for the last 2 months I am convinced the City of Saint Paul is not someplace I want to live.
Now what was this about just allegations that we heard so much about from the SPIF'ers? There was never any doubt in my mind cause I know someone the city screwed over, but this adds a new dimension to it!
So what happens if the lawsuit goes against the plaintiffs?
I see where Bob is going with this and people like Chuck Repke, Keilkopf, Fratto, Bogen, and others from Saint Paul Issues and Forums are going to look like raving idiots real soon.

I dont' believe a word of any of this! Please join me you non-believers, you citizen of st. paul and voice our opinions to the court of why we don't want council members to be deposed! Come let's meet there and plan our strategy. If we can put enough confusion in the system, we will be able to stump then, yet again. We can shout to them that if they are deposed, it will blow everything out of proportion. I mean Lantry didn't really mean to condemn homes and mangle lives, it was just her job. Kelly was just trying to appease you and I and if a few got rolled.... well....
Politics have always taken the little guy and squashed the crap out of him, that's just collateral damage for a well run department. See the job they are doing, they are almost finished. Soon you will find no person of color living next to you. You will find only yourself and others just like you. See the fine job they did at our beckoning and call to order.
11:14, if it goes against them at this level of the hearings it will progress to an even higher court.
P.S. if it goes against them it shows the connection between all these people. For pete sake their own people are telling the truth.

I remember reading all the complaints some time ago and I don't recall any of this stuff. What is said in the complaints and now this added to it makes me wonder what they are really doing that we don't know about yet.
They want to run us black folk out of the City so we don't have a vote.

Come on,you think the courts aren't stacked to! This Judge is going to side with the city and sweep this under the rug. I'm sure the attorney for the city is well aware of what he must do. All he has to do is stretch this out for as long as he can and eventually the plantiffs will be forced to settle for a much smaller amount than if this was heard by a jury. I am a lawyer- This is the way the system works! I have seen similar cites across the country fight, fight, fight-then settle.
It is what the court wants and ultimalely is the least inexpensive way to go.

8:31, I hope they don't settle. I'd rather a jury heard this story. I want 12 of my peers to be as discussed as I am at the City for these policies that have destroyed so many lives!

Nothing has changed in this case. The case is still with no merrit. In order to have a racketeering case someone has to profit from the actions of the elected officials. It is not a racketeering case under the Federal statutes just because someone got hurt. So, even if everything everyone said happened to them was true, who made any money out of all of these things that happened to these landlords?
Those pushing the case would have you believe that the non-profit Public Housing Agency was who was the beneficary of this racketeering!
That ladies and gentlemen is insane...
They are non-profit, they don't make any money and they aren't in very good financial shape, so me thinks it will be a little hard to prove that they got bundles of cash from these landlords misfortune.
So, you can believe that these people were targeted for unfair treatment because Randy or Andy or some council member didn't like them or some inspector didn't like them but it isn't racketeering if nobody made any money out of it.
The case is nothing more than an effort to harras City officials. People who think they got screwed by the City want to screw back and they are using the courts to do it. I am sure they are having a lot of fun wasting your tax dollars.

I do have a couple of questions though. As understand the law however, it enables persons financially injured by a pattern of criminal activity to seek redress through the state or federal courts. This would apply in this instance.
But I can't see where any of the racketeering definitions are met or where any of the acts that are indictable under Title 18 apply.

These lawsuits in my opinion have HUGE MERIT I live and breath this stuff everyday. I am sitting here in a pile of shit and it's getting deeper and deeper. I am ashamed of my City Officials.

I think you are a little confused Chuck. They don't have to profit, they have to benifet, and they did. The city has benifeted from all the fees generated by the illegal code enforcement such as legislative hearing fees, code compliance fees, fines, excessive use fees, vacant building fees, building permits, and more. PHA has also benifeted in recieving money from the HUD regarding their rental operations. Inspections employees have also benifeted through job promotions. Some of those same inspections employees have benifeted from operating their own problem properties both rental and commercial. For RICO to exist, there must be mail fraud and wire fraud. There was mail fraud when the city mailed out notices containing trumped up repair orders. Then there has to be wire fraud. There was wire fraud when the city caused the landlrods to move funds out of a federally insured bank account to pay for the illegal repairs, and also when the landlords paid for the repairs with credit cards. The last prong of the law is what they call "pattern," and this has been going on for so olong that the pattern is absolute. The way I see it Chuck, you're city is screwed, and the longer they try to play games with this lawsuit, the more it is going to cost them. As for being harrasses, you haven't seen anything yet Chuck. When these landlords prove their case, there are going to be a flood of lawsuits for years to come both by landlords and by tenants who were injured. You have been spouting off for a long time Chuck.....keep it up

Chuck and I have been adversaries on this issue for over a year.. He has always been respectful to me and I have been respectful to Chuck..

Yeah well look deeper Bob--Chuck is the Guy that lobbied city council and code enforcement to rid the eastsaide of low income minority tenants so his new development would be a success and white middle class people would come and fill his units.
I'm from the eastside and have seen the distructive policies of these groups and special interest.They are the ones putting the political preasure on the mayor,council and code enforcement.

Back to the issue at hand. Chuck is right. You all have legs to stand on and filing a case is reserved for anyone. You don't even have to be a citizen to do so.
You all seem to speak so strongly for minorities, yet when I look at you, I can't see a non-white face among us. Eric and Bob's son excluded.
Where are the groups of minorities you're speaking up for? Why didn't you simply pack the hearing with them? The media would have ate that up and the liberals would have been hard pressed to deny them to their face?
I'll gander and thought why. Maybe because this is really about your own pockets and refusal to fall within code. It seems as though you beleive that minorities and poor people don't have a right to live in a clean safe place. Who determines clean and safe? Well the city of course. It's their job to enact across the board ordinances. Every business that operates in the city, any city, any state, have a set of rules and regulations they must follow or they lose their right to operate their business, in the city. Why are landlords any different?
