They could not afford to fix their homes last summer.

I suppose this hearing will include members of the legislature and the Governor that would have to approve of such a scam.

As it is now,the city has no authority to exempt or alter itself from " State Building Code ".

They could possibly re-write their city building code, but not state building code.

Or, rally behind Nancy Lazaryan again. Of course she has been kicked out and banned from the Capitol now. Republicans thought she was normal until the met her, now their spokes person is quoted saying the she is clearly mentally disturbed.

This probably won't go to the floor until next year since the session is scheduled to end in a week.

No one from ADemocracy has the credibility to approach anyone about this. You have the right to do it of course but, know that your words of the politicians all being corrupt as well as the judges and especially the DFL coupled with Nancy Lazaryan being the last person you sent to the capitol, your words will fall on deaf ears.

The victims of this so far are the shitty landlords. In three years, and an entire federal court hearing, you failed to produce the names of any of the "500" you claim. Minorities and the poor are still taking some of these landlords to court to fix their damn property.

Its over, you will now have to take care of your property if you want to go into the rental business in Minnesota. Just like Wisconsin, North Dakota and South Dakota.

You've had it far too easy for far too long.

If you use code enforcement to go after me, or anyone you don't agree with, you are just as corrupt as those you accuse of being so. Not to mention, that you blow your case- yet again. Especially when the likes of Chuck, Thune and myself can walk into the courtroom and testify that we have dealt with code enforcement because someone complains. It further supports the city position that no one is targeted as it is a COMPLAINT based system. You kind of make our point for us, ya damn idiot.

I live in my own home. These landlords are suing over the condition of the rental property they own. Their businesses.
If we want to start posting information about their private homes, I'm all for it as I know for a fact that some of the burbs they live in are much more strict on code enforcement. We also can be sure that their private home is in better shape than their rental property, which could also be entered as evidence that they do know the difference.

Tommy Boy, anything they find on my house, I can pay for and upgrade. I work. I save. It will only improve the value of our property here.

Oh and Tommy Boy, a lot of people want to see guys like you get what you got coming to them. You may think those calls are anonymous. (Hmmm, slumlord sympathizer who is suing and spewing about the corruption of code enforcement, has friend call in on person who supports code enforcement and city employees. I wonder what would happen?) I'll be sure to pull every string I can to find out where the complaint came from. Just so I can say thanks of course. I appreciate active citizens looking out for the betterment of society.

Tell us, which landlords are being targeted and what is the reason, which should clearly be stated in the appeal, the city is targeting this 1% of landlords?

Aside from the sidebar discussions, I remember saying that this is nothing but Nancy grandstanding and seeing things in the law that 201 legislators and 100 judges missed every year for 40 years.

I also remember two weeks ago, Nancy Lazaryan still hadn't had a hearing and was being dragged out of the Capitol by the police and given an order to stay away. I remember the Republican Communications Director writing that she was obviously mentally disturbed.

Slander would have to include something false, not something you don't agree with.

Nancy lied on her press release.
Her 'ad-hoc' committee never met.
The purpose of the proposed meeting was not as SHE stated in her poorly written release.

She was arrested and removed from the capitol two weeks ago.
She was dragged out, while screaming about being a journalist and her rights.
The Communications Director for the the Republican Caucus sent out a notice how she disrupted the morning and was clearly mentally disabled.

Nancy Lazaryan has once again accomplished nothing except to make a victim out of herself. Just like she did at city hall, county building and now the state capitol. She chooses the hard route to feed her need for attention.

You're also wrong on my friends bill, that's listed in the current topic. I stated that a new bill being introduced during the last week of session of a budget year, will probably not be voted on this year.

You got any links for that? You seem to have them for everything else.

Tom since when do two wrongs make things right, code enforcement is wrong with some of their procedures and so is being a snitch baby! Many of us here have had to deal with code enforcement and felt we were treated unfairly. Using code enforcement as a form of retaliation is wrong, no matter how you look at it.

Erics opinions typically include facts that add value to many of the topics here, everyone has a right to voice thier opinion here including you but your threats are a bullshit way to stomp your feet.

Eric - been there done that.

These guys have called code on me a half a dozen times. Shit happens.

They have done it enough now that they know that it is only crank calls.

What people forget is that the code people give EVERYONE reasonable time to get work done. The issue with the landlords in the law suits and the folks who have been condemned is that they either would not (wouldn't spend the money) or could not (didn't have the money) repair their properties.

Time is not the issue. Go back on these cases, they all go year after year, after year with the complaint not being taken care of.

And, Bill when will you understand that the City has nothing, zero, zilch to do with a private contract between a homeowner and a contractor? That is what I don't get about your insanity. What is the fixation that the City or the DFL party was in someway suppose to have the power to resolve a contract dispute? You contract with a private non-profit to do work in your home, you were not satisfied with that work and you expect some level of government that didn't license these people to make them make you happy.

It is kinda like you bought something at Walmart and you go to Target and complain about it and expect them to fix it for you.

What made you think that me (city council staff) or Eric (DFL staff) could somehow magically become the judge and jury on a law suit you might have had with this non-profit?

Chuck it sounds like you have some problems to take care of or should at least check into at your rental property. Its called being a responsible property owner Chuck before you are so quick to judge other property owners sounds like you may want to take a look at yourself first. Must be great to have friends at city hall to cover your ass for you, but do you feel it is fair for the neighbors to have to live next to your rental property assuming that it really looks like what Ciani has described? Pictures would be nice to show whether it is true or not.

Tim - there is no on street parking without permits, so everyone parks in the back off of the alley.

All of the tenants cars are licensed DSI was just out there in March and tagged the one that wasn't. The motorcycle trailer is licensed. The other trailer is for the snow blower. The wood (which is from trees that were cut down in the yard) is stacked legally and is being used by the tenants in the legal fire pit they have in the backyard.

DSI also responded to your "overcrowding" bullshit for the fourth mother fucking time ass hole. There are 4 people living in the four bedroom duplex. DSI called to complain that they couldn't get access because there was never anyone home... I laughed and said, sounds like it isn't very crowded if there is no one there... So, a tenant had to take off work because of the ass holes on this list.

Next time you come over dip shit if they catch you slashing tires again (three times this year) one of my tenants has promised to cut your balls off and feed them to you, if you have any...

I am not sure if it is you or Dahn that is the nut case doing that but you better hope its the cops that catch you.

It is amazing how crazy the people are that are on this list. Piss ants that have so little going for themselves they stalk my house. And, remember I have never been elected to public office, I just have the guts to stand up to these cowards and liars that are on this list. As I have said from the begining the entire group involved in the suit are cowards and bullies that make their livelihood taking advantage of the poor and they don't like being confronted or being held accountable.

Back in early March someone was threatening to get DSI on me; the next day someone slashes the tires on the cars in back of my house; my tenant has to take the tires to be repaired and some ass hole on the list calls DSI then to report the car up on blocks.

Pure cowardly pricks on this list.

Bob sends me an email and says must be my tenants that have problems... yeh right.

1. I support code enforcement of unkept property and unsafe situations. Since I am not a hypocrite, you are welcome to give them call on me.

2. It is cowardly and hypocritical for those who want to dismantle code enforcement and complain about its unfair tactics, to try and threaten people by calling them. The dishonesty and stupidity goes beyond those who lost the lawsuit.

3. Its a Pinko Commie anti-American move to call the 'authorities' on someone over their speech. Its more American to threaten to kick their ass for what they say than to try to shut them down for what they say.

4. You can't beat me using your head and putting forth a supportive argument specifically on the conspiracy theory, you can't threaten me physically- because that's crazy on your part, and you can't call the authorities on me because, unlike you, my shit is together. I don't own any rental property in St Paul so, I can be clear when I state, my house is fine.

The color of a persons skin does not make the person and is not a valid cause for the personal attacks on each other. First, I would like to thank Chuck and Eric for helping get out that my home was F--ked up by RAP and no one wanted to help me in city government, except Dave Thune's aide Chuck Repke.
Thank you Chuck for trying to help me with my home, and then the city attorney told people not to help me.
So the only thing I still have against the two of you is that you are two of the biggest kiss asses that the Democratic Party has.
But for the blacks not to care about their own, having the bad stuff, that RAP did 200,000 homes in Minnesota with.
And whites did not care about their own either, and then the dam Indian aka red skins did not care if their people were being poison with formaldehyde.
Watch next years election for governor and see how some of the people running on the DFL Party gets the bad press they deserve.
The Minnesota's Crooked est Party is the DFL.

Ralph - despite what Rush tells you Social Security is doing just fine. It is still fully funded. The reason why nobody on SSI is getting a raise this year is that there has been "0", zero, none, null, cost of living increase.

You may have been out of town and didn't notice but the price of gas went from $4.00 to $2.30 in the past year. That means no inflation and no cost of living adjustment. There were big raises when gas was going up...

As to having a key. I have a key, but the tenant and I have a good relationship. I give him a break on the rent to maintain the yard, and deal with that.

Just because something is bringing in more then it is paying out today and we see a cliff coming down the road doesn't mean doing fine.It means on the road to bankrupt.Would you but my business if you knew it was pulling in more money today but in 7 years it would be in the black?Ah no!

SSI is solvent until 2037. Does that mean in 2010 we need to do something to fix it? Yes. Does that mean we need to fix it before we deal with the stock market crash? NO. Does that mean that we need to fix it more than stimulate the economy? No.

Does that mean that morons like Rush will try to make the problem of 27 years from now more important than the one of today? Of course they will. Because they hate America and what is stands for.

Freedom, Liberty, Justice, Hope all are concepts that people like Rush despise. Rush likes the economy in crisis because he has something to blame on the poor, the disadvantaged and the needy. He gets a chance to spin hate, and fear and that is what he lives for.

This is the appeal of the Summary Judgement. No surprises, but again no clarity as to what in the world these people think the claim is against the City.

The new spin on the case all rests on the state case of Morris v Sax and that somehow the City was using a higher standard than the state building code (when the only code the city was using was the state building code). So, the new spin is that somehow the city should have records of the state building code for every year and that when is checks on property it should go back to the year that the building was built and determine if a building needs in door plumbing or electricity based on what year the building was built.

So, if you have a rental built in 1917 you don't need a working toilet or running water or electricity and that if the City were to try to enforce the "new code" on these landlords then it must be a violation of the fair housing act, because poor people (and those of color) don't like in-door plumbing and electricity. They want the shacks these guys own.

The case is dead.

The appeal is DOA.

The lawyers are at this point laughing all the way to the bank while they take more checks from the landlords.

They don't even try to make this a Federal RICO case anymore, which it started out as... so, now it is protect the rights of the poor (and black) to live without working toilets.

Just sad.

What? Who is making that argument? Please, identify the landlord saying that and I will join you in publicly condemning them. The reason we are against HF2362 is because we object to things like this:

St. Paul window police making a homeowner change their window to a new size only to have a different window cop require the SAME homeowner change it again a few months later to yet another opening size (read the article in the strib).

St. Paul requiring a property owner to bring a vacant building up to current day code even though it was vacant/non-compliant for less than the one year period required by State Building Code.

Targeting zealous code inspectors on addresses where there are perceived behavioral problems. What does maintenance/building code have to do with behavior?

St. Paul sending us notices to fix our properties and giving us only three days to remedy issues. State civil law specifies one must give time just to assume the letter got through the mail!

Besides, I don’t understand your – or the officials that spoke at the hearing on HF 2362 – stance. You claim to be in compliance with the State Building Code, but you appear desperate to pass HF2362. The sole purpose of HF 2362 is to relieve cities of the State Building Code. If St. Paul is in compliance with the State Building Code, then why the desperation to be relieved of the State Code?

Bill what I was talking about is the argument in Harrilal vs City of Saint Paul in the link Sharron attached.

Whenever any of the landlord cases focus on "New Code" vs Code when the building was build... or the loss of "grandfathering" which should continue with a building, the problem in their argument is exactly what I said.

If my duplex that was built in 1887 has "grandfathering rights" and that inspectors ..."must use the state code that was in effect when the building was built..." which is the arguments that the landlords make, then that means if true that the City can't require that I have electricity or working plumbing because the house was built to code in 1887 with an outhouse and no electricity.

You can't argue that only some of the "new code" should apply and others should not. Who is to determine? So, arguing for a building having grandfathering rights means about 25% of Saint Paul's homes won't need electricity or plumbing.

The case goes nowhere....

...and when the landlords try to extend Morris v Sax to grandfathering rights they create the same problems.

My response;

A Democracy Town Hall will continue on regardless of the outcome of the fair housing lawsuits. Elections never end, there will be work to do. Also, folks who need help have found it here I wouldn't want to take that away from anyone.

Many of us feel the district councils are not representative of the common man in Saint Paul, they serve a political entity. So there is a need for an electronic town hall like A Democracy.

Bigotry- A Democracy Town Hall is representative of our society, and by far isn't the only place one can find prejudice. I am proud of the fact bigotry is exposed here. At neighborhood or district council meetings folks tend to hide their bigotry and we never get to see some of the issues or people for who they are.

District councils- Here is one of the things I shake my head at and wonder where is the thinking. In a newspaper ad, a certain district council on the east side promotes "snitching" on your neighbors for their abandon cars so Budget Towing can tow the cars and clean up the neighborhood. The council brags about Budget Towing donating money to the council as if this is a good reason to snitch on your neighbor. HEY, how about going to your neighbor and knocking at the door and talking to them about abandon cars or anything else that my be concerning you? WHY, aren't the district councils preaching getting along with your neighbors?

NO, they want you to SNTICH, SNITCH, and SNITCH some more. Call the police, call the dog catcher, call the district council, call BUDGET Towing, call your councilman, call the health department. Snitch, snitch, snitch.... NOT, a good way to get along with your neighbor!

And one last reason for A Democracy to continue on. Bill Dahn tells me he hasn't had to call political bureaucrats on the phone because he knows they read the blog. SO, I am sure there is someone working for the city, state or county who is real appreciative Bill isn't calling them and they have this forum to thank for that. :)

Bob - as a staff person for a district council on the East Side that doesn't have a relationship with Budget Towing (which one does?) all I can tell you is that most of our effort it about getting neighbors to talk to each other, not snitching on each other.

That is why we have block clubs to get neighbors talking to each other. District Council like ours watch out for each other and invite everyone in the neighborhood to be a part. We even invite landlords! We also let landlords know if there are issues going on in their properties so that they can check it out themselves.

One of our big efforts in the past two years has been an auto theft reduction program. That means getting into apartment buildings and talking to the renters about watching out for each other too! Over the last 2 years 25% of the auto theft reduction in Saint Paul has come from our area.

So, Bob I don't have a clue what you are talking about and I wish you would actually see who is involved in the neighborhood groups before slamming them all.

I thought I was right but just wanted to be sure leagally.
We see that some people are trying their best to discredit me as a candidate for mayor, this happens each time that I put my name in on the ballet.

Look bad at any election I was in and think of all the money other candidates spend and that I do not spend over $50.00.

The trillion dollar spending plan is already reaping benefits. Aside from that fact, the pentagon is doing an aggressive audit going after eliminating no-bid contracts (remember the 9 billion that came up missing in Iraq) and more competitive pricing (no more Haliburtion and KBR price gauging). Defense Secretary estimates about 300 billion to be saved. Closing the offshore loopholes is estimated to yield us 700 billion over the next ten years.

If the economy does absolutely nothing, then we break even Ralph. Aren't you even concerned that 66% of corporations find a way to pay ZERO federal taxes? Others on average find themselves paying about 2%. I'm no expert but I'm willing to bet the average Joe is paying more than 2% in taxes to the federal government. You think that burden is due to the rich and corporations having so many ways not to pay their fair share?

Over in Central St Paul,they do tend to be cliques of active neighbors. in the North End and East Side, it tends to be a few interested people but, rarely the political connected. Rarely are they actually full. Most times, you just show up at the annual meeting without prep and can get elected to the council. No, conspiracy or political difficulty on these councils in the poorer areas.

I know, I am at the center of this issue and I hear the same story from investors who don't even know each other. Don't believe me, ask (K.D.) Kathy Lantry's old landlord and good friend. Thanks for letting us know who'll be filling your water dish from this point on. You're so deep in their pockets that you can't see the people you say you want to help are not being served by the condition that some of these landlords allow their rental property to thrive in.

No industry likes the enforcement or regulatory arm. The FCC, SEC, FDA, etc. all get complaints from the industry they regulate. However, the people ask for these standards and expect the government to enforce these standards.

If you all really wanted to do something about it, you'd stop pissing around with the likes of Bill Dahn and find some real candidates. One or two every couple of years. If you would have done this back in 2002, you could have had a majority on the council by now and rolled back some of these standards. If you believe the citizens of St Paul would support your issues. They don't. You know they don't. So your only recourse is the courts and a blog.

If you can't get the citizens behind you, maybe this isn't the city for you.

Chuck says: What in the heck does that mean? I love the silliness of those kinds of statements. First I have never been paid by the DFL Party to do anything. And, I have never gotten anything from the DFL Party.

From time to time, some campaign has paid me to assist their candidate in getting endorsed by the DFL Party and from time to time I have volunteered to get some candidate endorsed for free. I have also been a paid staff on campaigns and I have been a volunteer on campaigns.

What you don't get Bob and what most people don't get that never get off of their butts to get involved in the electoral process is that every year the party endorsement process starts from scratch. There is an equal shot for anyone in getting endorsed in either party if they can organize people to attend the caucus process.

What guys like you and the Bill's of the world complain about is that they have no constituency, no supporters, no one that listens to them, few who agree with their positions and then bitch that they don't have a chance in the party process.

I have on several occasions been able to get candidates endorsed for local office by getting them to get their friends in scouting, or in church groups or even their motorcycle club members to show up at the caucuses and get elected as delegates.

There are no "registered Democrats" in Minnesota. We don't have party registration. The process belongs entirely to those who show up.

The lazy, uninformed and those with no support base can bitch, but its pretty lame.

I have never stuck up for inspectors who lie. I've been around for over 3 years and have said over and over that it is possible and probable that there are some bad apples. We find them throughout other departments too like Police and Parks and Rec. However, a few bad apples do not reflect on the whole department and there are ways to handle it.

I'll be clear again on my position:

I stand against the RICO suit. There has been zero evidence presented that there is conspiracy between the city officials, inspectors, county attorney and judges. That's what RICO was presenting. There has been nothing.

I am doubtful on the Fair Housing aspect of the suit. In the testimony I read here, many of the tenants were not of a protective class, but more telling is that some of these landlords admit to having black tenants in other buildings and have no problem with the city on that property.

Also in their own testimony, they admit to having code problems and not addressing them until contacted by the city. One admitted that he bought the property knowing he didn't have the money to bring it up to code, and let it fall into further disrepair while renting units in it.

If these landlords were really interested in solving the problem of a wayward, rogue or jerk working for code enforcement, suing the city and claiming a government wide RICO suit was in order was not the way to go. Over three years later and after dismissal of the Federal Case, here we are.

You need to pay attention and stop letting other tell you how and what to think. Read what these people write. Read the testimony of the landlords. Then think.

This election might cost the Democrat Party more money because of the people who don't want the Chris Coleman's party in again.
The hmong or dahn will win this 2009 Election.
