The City of St. Paul has settled a lawsuit brought by an anti-war organizer who claimed police unlawfully detained him for distributing leaflets during then-Sen. Barack Obama's rally last summer.

City Attorney John Choi confirmed today that the city will pay $5,000 to Mick Kelly, an organizer with the Coalition to March on the RNC and Stop the War.

Kelly, of Minneapolis, was cited June 5 outside the Xcel Energy Center as he distributed leaflets about his group's planned Sept. 1 march during the Republican National Convention. He was cited for peddling near the entrance of an entertainment venue within three hours of an event.

Police later canceled the citation, as the ordinance refers to people selling goods, not leafleting.

Kelly's lawsuit claiming excessive force by police during the RNC is pending.

Eric, this decision to pay this guy $5'000.00 is a drop in the bucket and the guy probably deserves more.The court didn't award it, so the settlement had nothing to do with the decision of a judge or jury. Of course the judge will have to sign off on it and the attorney will get his 30%.

The city is simply saving face
( or money by settling this part of his lawsuit ). They violated this guys rights and they admit it by paying.

Now you watch the city fight tooth and nail over his excessive force claims.

If the evidence is strong, the city will settle this one to with the common statement that " We settle but admit no wrongdoing " !

This is where the guy looses. This is where the city and judges are holding hands.

You don't know jack about how these things work.

More ammunition to use against the Coleman administration and the Police Dept.

You're right. I guess my background, experience and former positions mean nothing.

1. "Probably" doesn't shake it in court. Does he deserve it or not? You start off unsure because you are no familiar with the case, only the story.

2. Settlements absolutely have to do with the judge and jury (and evidence). Since the police admitted they were wrong in writing two days after the event, it appears that all sides wanted to put this incident to rest.

3. How would you know the attorney costs? For all you know, he got a pro bono ACLU attorney. (Which he did).

While I'm at it, for all you know, the guy is from Mars.

I know that he is a DFL activist.

I know that if you and most people's theory hold up that the DFL runs this town crooked, this would not have made it to court.

If you theory was legit, so called DFL cops would not arrest a DFL activist passing out flyers at a Democratic Event to other DFLers on information on the Republican National Committee.

I know the bigger suit that he is focused on is the September excessive force suit. Which will probably be a winner.

But, don't go counting these people in your court. They are mad at the police force but, would not for one second align themselves with the people that work against (Republicans).

You're right loser, I don't know how it works.

And, be happy I left it at 'loser'. I am well aware of your little racist nickname for me.

I am sure he deserved it Eric because the city doesn't give out money for nothing. Even when they admit no wrong doing.

Your former positions (usually with your two legs wrapped
around your head and bobbing on (something) means nothing when it comes to experience with the judicial system .

Settlements have to do with a jury only when one has been seated and the judge informs the jury that there has been a settlement on any one given claim.

There is no such thing as a free attorney.

Name one attorney that works for free ?

When these ACLU attorneys win for litigants against government and the plaintiff gets settlement money, we tax payors pay the bill.

You may call it working for free, but it ends up being ACLU wins against tax payors like you Eric.

Doesn't that make you feel good that the very administration you root for is so corrupt as to take your tax dollars as a consequence for police misconduct ?

Former positions on oversight commissions. You know, where you get to examine all the evidence, even that that may not be admissible in court? Or the civil rights commission. Or judicial review and procedures?

Oh Jeff, your infinite wisdom has once again enlightened me that one can bullshit nobody but themselves, and still pretend to be knowledgeable. Amazing.

As a card carrying member of the ACLU (well not for a few years to be honest), I am familiar with the organization's operations. Very recently, I was the communications director and one of the lobbyist for the Trial Lawyers Association (the guys you turn to for civil suits). It would be a hard position to get with little or no knowledge of legal proceedings.

I am 100% with Mick Kelly on this. The cops had no right to detain him.
However, this is a case of your theory of the corrupt city, courts and party not playing out at all.

You're bat-shit out of your mind if you think my party is against the Anti-War material he was passing out. Those cops were probably pissed off about it, matched with all of the Libs downtown that night for the Obama rally and took it out on Kelly. Mick Kelly, the Mayor, City Attorney and County Attorney are all DFLers. As I am.

I didn't catch your background which affords you such 'expertise'.

Can you tell us all in between your SHAM-WOW patent work?

That doesn't require any amount of legal experience.

You sure your not talking about all your telemarketing jobs you have had ?

I am a member of the NRA and carry a member card but that doesn't make me a sniper.

Have you ever did pro-se legal actions on your behalf ?

Have you ever been a power of attorney for someone else ?

Have you ever won a conciliation court case ?

Have you ever written a legal brief in the Court of Appeals ?

Do you understand the General Rules of Practice, Rules of Civil procedure, Rules of Evidence, Family Court Rules, Rules of Appellate procedure, and do you understand any concepts of tort law ?

All this I have done and understand.

You Eric, have non of the above to your credit.

The city settling has nothing to do with being right or wrong. Right now the city is flooded with litigation and it's worth the $5,000. to have the time and resources to focus on bigger and more important issues. The city is never worng Jeff.

Don't be so sure about this Eric. All sides came together to get rid of Randy Kelly and it had every bit as much to do with all the other things he did to anger people just as much as supporting Bush.

Coleman will see the same political demise. He's going to have everyone with a beef come together to get rid of him.

You are on the losing side of these issues and it's Amanda to your rescue. Which here idea of a rescue is to throw you a brick instead of a life jacket.

Why do you think Jeff posts anonymously just because some happens to take his position when he's right Amanda? What position is it that he has to come on anonymously and support when he's right from the get go you fool? In case you haven't noticed, people here like Jeff.....he doesn't have to justify squat. if they are paying $5,000 for this, and its only a drop in the bucket.
now the landlord should win their case, this shows that the city was wrong in this one.
the city government is wrong in this one and in most casses they conceal the truth and destoy the evendence.
to protect themselves from lawsuits, they Just call all cases Frivolous.
