Mpls. pays settlement to black officers in bias suit

The city of Minneapolis agreed Friday to pay five high-ranking black officers $740,000 to settle a lawsuit they filed in 2007, alleging racial discrimination and a hostile working environment.

Lt. Don Harris, Lt. Medaria Arradondo and Sgt. Charlie Adams each will receive $187,000, Lt. Lee Edwards $137,000, and Sgt. Dennis Hamilton $40,000.

The settlement, which includes the plaintiffs' legal fees, does not mandate that the city change any policies or practices.

"The amount of the settlement is extremely significant in race discrimination [cases] in the state, especially against a public entity," John Klassen and Andrew Muller, attorneys for the plaintiffs, said in a joint statement. "The Police Department hasn't [ever] paid this amount in an employment discrimination case, to our knowledge."

The five officers sued the city and police Chief Tim Dolan in December 2007, alleging a history of discrimination in the department and asserting that it became more institutionalized after Dolan became chief. The five had an average length of service of 20 years.

The suit focused on three personnel moves by Dolan: the reassignment of Harris and Edwards to lower positions, and the transfer of Adams from the homicide unit. The city already has paid Adams an $85,000 settlement over comments Dolan made after the transfer.

Last summer, the Minneapolis City Council rejected a $2 million settlement offer. Friday, the council voted 12-1 to approve the $740,000 settlement. Lisa Goodman voted no. A trial had been set for March 2010.

Labeled 'disgruntled cops'

"Our settlement doesn't acknowledge any discrimination, but we want to put these allegations behind us," said council President Barb Johnson. "The Police Department has already made changes to address some of the issues raised and will continue to work to improve the climate. We were happy to move forward."

Dolan deferred comment Friday to a city spokesman. When the 38-page suit was filed in December 2007, Dolan issued a statement saying he was committed to building and retaining a diverse police force reflecting the city's population.

Three months earlier, several black officers had met with the director of the city's Civil Rights Department to voice concerns about racial issues, but the director dismissed the allegations and later publicly called the officers "disgruntled cops near the end of their careers," the suit said.

The department had only one officer of color with a rank higher than lieutenant when the suit was filed, but Dolan has since promoted two more. About 18 percent in the department are officers of color.

The suit claimed that black officers received fewer opportunities for training, special duty and overtime, as well as fewer appointments to key units. It also claimed that the department had failed in several areas of diversity required by a mediation agreement reached with the help of the U.S. Department of Justice.

The suit alleged that the department refused to pay overtime to Arradondo, head of the Fourth Precinct's community response team, for the key role he played in critical incidents. Harris, a Fourth Precinct investigator, was passed over for appointments in favor of white officers, the suit said.

Potential 'catalyst for change'

While several white homicide officers got more than 150 hours overtime during the Interstate 35W bridge collapse, no one informed Adams of that opportunity until the last days of the detail, the suit said. The department fired Hamilton for infractions that didn't get white officers fired, the suit said.

The department demoted Edwards, former head of the homicide unit and an inspector, after accusing him of driving a department vehicle intoxicated and making offensive comments to subordinates. But the suit said the department then replaced Edwards temporarily with a white lieutenant with a lengthy history of civil rights violations.

Edwards, cleared recently of criminal wrongdoing in a federal corruption investigation, was suspended without pay for related departmental violations. The department's Internal Affairs Unit found that he violated codes of conduct and ethics in dealing with a high-ranking member of the Gangster Disciples gang. He faced six internal affairs allegations; four were sustained in a report completed last summer.

"Litigation, especially litigation with current employees, can be hard on everyone," said Assistant City Attorney James Moore. "We want to ... move forward on the important business of the Minneapolis Police Department. We also look forward to having plaintiffs work with us to accomplish our goals."

Zach Metoyer, former co-chair of the Police Community Relations Council, said he was happy for the officers. But he added that he wished the court would have ordered the department to change how it treats officers of color.

Citing the same perceived shortcoming, Al Flowers, who had been on the Community Relations Council, said "he was flat-out disappointed" with the settlement.

But attorney Muller said it could have long-term impact.

"No one would wish to go through what these five officers went through," said Muller. "The suit could be a catalyst for change. Time will tell what the department's commitment is to those issues."

This is a win win for cops, lawyers and government officials.

The message sent here to the public as is most always the case when government discriminates or violates peoples right, is we give you tax payor money so we can put " Whatever " behind us. We are not guilty of anything but here you go.

It could and should, turn around and bite these city council members in the ass around election time.

Never does a city admit to any wrong doing, but always pays out with the same old fucking excuse.

After attorneys fees, these officers won't have much left of the settlement.

If the case was strong, why didn't these cops go for the 2 million !

It would be in the plaintiffs attorneys best financial interests to go all the way.

They didn't have to sell out to a corrupt city council .

These plaintiff cops have not done much to dampen the atmosphere of corruption.

Citys are not immune to civil rights punitive damages awards.

What are the plaintiffs attorneys so afraid of ?

In the end, I sympathize little for these officers who took peanuts for such a good case of discrimination.

Think of all the wite paint the city of Minneapolis could have bought with $ 740'000.00 !!!

As usual, Jeff knows nothing of what he writes. A erroneously types whatever his brain farts up.

I know two of the cops quite well.
I'm a former Minneapolis Civil Right Commissioner and some of these names are not new (though I'm not able to publicly discuss that).
I was around for the agreement when the Justice Department had to intervene. I knew then it was probably not going to sustain desirable results and voiced it at the time.

I have written everywhere, including several times on this blog going back to 2001, the racial discrimination mindset that exists in the Minneapolis Police Department.

The problem is throughout the department and its been so bad for so long that minor successes are celebrated. Like this one.

If Jeff knew how much that department is sued, how many settlements and most of all, the length of time it takes to get anything going, he'd know that this is a big signal that while attitudes may be slow to change, the legal process is moving faster- which puts political pressure on the elected officials.

Cities lost control of their cops when the state ruled that residency violates the rights of cops (this lobby was led by the Minneapolis Police Federation). Most of you on here support the removal of residency requirements.

These cops are good cops that have experience with accommodations, great skills and the respect from the community they police. Unlike some colleagues, that drive 30 miles into work and then leave right after, a couple of them grew up in Mpls and live there.

The article details what each officer will receive but it also states that the settlement includes legal fees. If you add up what each officer is getting, you'll see there is about $250,000 left over. That's what will pay the legal fees. Good going with the math Jeff. You're too lazy to even read carefully. Good going Sally Sleuth.

Councilmember Barb Johnson is a cops candidate. Lisa Goodman is a big progressive. I can only guess that Lisa voted against this because a trial may have resulted in much needed, but rarely enforced policy changes.

The article noted that the settlement does not mandate the city to change its practices or any policies.

Saint Paul cops for the most part are night and day different from Minneapolis. Remember that.

The only thing moving faster about the legal system in these kinds of cases is the rate in which the city is acting even quicker to pay out .

I guess its Eric that sets the price for what he thinks is a fair settlement.

My opinion is that its not enough and far less than the 2 million the plaintiffs attorneys think they deserve for their clients.

You do the math on that one Mr.7th grade schooler.

Then tell me why the plaintiffs settled on the cheap.

Tell us why St.Paul cops are like night and day from Minneapolis cops.

You ever live in Minneapolis to know Eric ?

To admit guilt by the department would mean some employees would have to be fired.

The police department admitting that changes are being made, is some evidence of guilt.

$ 740'000.00 is a hell of alot of money.

What was the main reason for the payoff ?

" But we want to put these allegations behind us ".

The big question is what policys or rules are being changed ?

Answer these questions, and you will know just what exactly the city admits they did wrong.

These changes will not be made public.

Think I will call Minneapolis Police department or city council.

Do you think either will tell me what changes are being made ?

Do you think I have a right to know ?

1. Yes, I lived in Minneapolis. One of the places I lived was the Fifth Ward. I worked in Minneapolis politics before St Paul. I was a Minneapolis Civil Rights Commissioner and saw dozens of complaints. Many were backed up to the previous commission that didn't have the same authority that we did. We did a lot and streamlined the process for citizens. Our main problem was that with so much time passed, many accusations couldn't be proved and statements were fading.

2. The city does not have control over their police department. Most of these council members are pretty new and weren't around ten years ago. Most of them are not protectors of bad law enforcement. Most of the Minneapolis council is further to the left of our council.

The police union (federation) is very strong. As I stated before, they were the ones to fight and win for the dissolution of the residency clause in city employees. They have been suspended for major crimes like machine gunning their own down (four years ago), multiple cases of blasting unarmed citizens, and multiple incidents racial harassment.

3. Jeff, you are by far the laziest and dumbest poster on here who thinks their opinion counts. If you weren't a bigot, I would throw 'sad' in there based on your previous 'celebrations' claiming you won something- after debating with yourself for five posts.

You jump to judgment with nothing. You don't have any statements from the case, evidence, or even an idea of charges and what they stem from. You have no idea of the strategy of the attorneys. The process of these kinds of cases but, you know the settlement was a 'payout'?

Get a job you lazy moocher. You criticize the government yet, you're so dependent on it you can't crap without filling out a form.

Eric, does the city council and mayor have anything to do with the hiring of its police chief ?

If they do, and they do, then yes, they are supposed to have control.

When the council agrees to settle cases against bad cops, then yes, the manner and amount in which they agree to settle sends a message to the citizens about the conduct of those officers.

City councils can be protectors of bad law enforcement if they do not vote to quell the bad conduct of its officers or proscribe changes in the department.

I can't help you were born black and I can't help that I was born a greek ( trying to be fair with you ).

You are a bitter person seeking to rise above yourself by chumping up and getting ass buddy from government politics to make you feel important above and beyond the crutch of your race.

Yes. I have watched three police chiefs fail at getting a hold on that department. Not my point.


If they do, and they do, then yes, they are supposed to have control.

In theory.
Ideally, you could scrape the top management and fire dozens of that leadership for failure to execute their duties.

That's just me, and probably too harsh and not Constitutional. So we are stuck with putting out fires as they happen instead of changing the mindset practices.

Who's disagreeing with you? I agree. I think the 4.5 million paid out to the cop who was machine gunned down was way too little.

Its not clear that that's the issue here. Maybe I'm old fashioned but I like to figure out what the hell was on these people's minds before casting blame. You receive some sort of trumped up disability check. You live in a rental unit. You don't work. You are working on some 'Sham-Wow' product in which you're seeking a patent for. Its your million dollar idea, right?

There happen to be posters here that would like to participate by offering their perspective the best way they can.

Some of us don't always spell things write, articulate as well as others, but Eric has to make these people into retarted folks so he can always have the spotlight on him.

Eric has never been elected to any kind of office by the people in Minnesota.

There happens to be a reason for this.

His political appointments are the result of misunderstood pre-conceived misconceptions about who he really is.

Good try attempting to define all I do is insult people. Try reading what I wrote, for the vast majority of it is pretty decent researched facts deconstructing what people just write without any support.

I've spent years in politics in the background. Most of you wouldn't know who the hell I am if Bob didn't tell you. I don't want to run for office. I understand myself well enough to know that being an elected official is not for me. Goes back to what I said at 12:16, I good with who I am.

Its ironic that again, a person is trying to 'dress' my character down and they can't even post under their name.

As far as spelling correctly and using proper grammar, go look at my exchange with Les. He insults me over and over and I never go after him on his writing skills. He's the worst. Well, next to Bill, whom I leave alone on that aspect too.

You're wrong from top to bottom. You are free to go back to any thread and point out my series of posts that support your points.

And finally, I don't 'need' this attention. I never posted here in the beginning except to ask them to stop dragging my name in their shit. (archives Sept 2006). If this blog folded up and died today, I'll be fine.

Ive been saying that for years. I'm good behind the scenes. Let's look at some numbers:

State Legislature pay: $29,000
Legislative Assistant in legislature: around $32,000 to $40,000
Committee Administrator for legislative committees:
$40,000 to $80,000.
Campaign consultant for several legislative races: $3000 to $5000/mnth
Campaign manager for statewide office (like AG) $5000/mnth
Campaign manager for Gov. up to $10,000/mnth.

A lobbyist to the legislature with some experience can earn $1500 to $5000 per month per client.

Are you getting it yet? You can make a better living behind the scenes.

The St Paul city council makes $52,286 year. The legislative aide the to the council member makes $60,000.

Department heads across the board (appointed by the mayor and approved by the council) make double the council members salary.

One day maybe but, while I'm still young and raising a family, elected office is not for us.

Bigotry and discrimination will always continue in this country as long as the Democrats keep letting illegals take our jobs and consume tax revenue.

According to the Congressional Research, and the Center on Budget and Policy, Illegals cannot and do not receive any welfare or tax benefits. Its hard enough for legal immigrants who have to pay in the social security for ten years before receiving any benefit.

Second, 'Americans' like you and Jeff, don't want to work. You sit on your ass and complain about people who come here to work. Smell the irony.

You want to stop undocumented workers from taking jobs? Fine the companies that hire them! Not some $200 slap on the wrist either. I'm talking about $5000 per worker per time.

Undocumented workers bring the wages down for other employees working that industry. Try starting a siding or roofing business and charge a prevailing wage per foot- you'll be laughed out of the business because there are so many undocumented laborers working for peanuts.

Same damn thing in the restaurant business. Take your choice of your favorite restaurants and go in the kitchens.

Of course my plan will cause a few things to increase in price but, it will be worth it in the long run for the health of our economy.

I support regular immigration with fair rules.
