A elderly woman was working on her home trying to comply with orders from housing code official Steve Magner when he appeared at her door and ordered a stop work order on her home informing her that her home would be demolished that she had not complied to meet his specifications. With superhuman strength borne of fury, she dragged him down the stairs, out the back door, and into the tool shed in the back yard and put his penis in a vice. She then secured it tightly and removed the handle.

Next she picked up a hacksaw. Magner screamed, he was terrified, as he screamed, "Stop! Stop! You're not going to cut it off, are you?"

The elderly woman, with a gleam of revenge in her eye, put the saw in Magners hand and said, "Nope. I'm going to set the shed on fire. You do whatever you have to." My home will stand!

I'm guessing that the court is saying two things, one that the City doesn't have the ability to make Magner give his records... and two that Magner isn't who the plaintiffs have been saying is who benefits from the grand conspiracy.

Like I have said before, you can't keep changing who and what you are suing about, it is suppose to be a conspiracy by elected and appointed officials to put landlords out of business to benefit PHA or whatever landlords aren't out of business or somebody.

When you start asking for Magners records you are suggesting that the Mayor and Dawkins are all conspirering to make Magner money... no one in their right mind would make that case.

If it is a simple extortion case of Magner against Nancy, then it isn't a RICO case. Got it?

You must not understand lawsuits very well Chuck. If the Discovery process leads to additional evidence of wrong doing, both sides are entitled to go after it. If looking at those tax records would have revealed additional wrong doing, the guy is a c ity employee. He was acting on behalf of the city, and thus the city would be responsible, just like when a cop beats someone up or a snowplow driver decides to drive throguh your living room. GOT IT REPKE?

How could this dumb bitch Nelson disregard four peoples sworn afidaviates attesting to Magners criminal behavior? The fuckin bastard Magner was caught red handed standing there with stolen goods from the gargage of 14 Jessamine.

I'm no attorney, but I am smart enough to know there is enough there for him to be arrested right now. I challenge anyone on this blog to go engage in that type of activity described and see how long it is before you are arrested and charged woith a crime. Talk about governemnt favoristism, I guess the laws are only for the ordinary people now days.

Maybe this Magner should have been inspecting the bridge that fell rather than going after property owners. Unsafe bridges apparantly are OK, but watch out if you have a torn screen or your grass is too long. This city is nothing but a joke, and a bad one at that.

No big deal. Thats what appeals are for and I assume the plaintiff will.Anybody with common sense can understand theres enough evidence for the courts to rule for this Magner guy to give up his tax and bank records.

Also I've heard through the grapevine the city has been destroying evidence and is going to get smacked by the courts.

If was accused of wrong doing I would be more than willing to give my records to prove that I was not breaking any laws and that I was honest.

That fact that Magner is running as fast as he can to not supply information has got to be there is some truth to his making money off home owners.

Also on a personal note why does the city not tell Marcia Morman to wash her hair...?

She is an embarrassment in her appearance to the city of St. Paul. I watched her on cable vision and she is appalling in her physical hygiene. WASH YOU HAIR!!!

9:10 Yes but... you have to be trying to discover something relative to the case.

The cases are listed on the side of this site they are all RICO cases and for RICO cases you need a conspiracy, a victim and someone who was to benefit from the damage done to the victim.

Read what the cases say. The plaintiffs say that the City (elected and appointed officials)conspired to put landlords out of business for the purpose of benefiting PHA or the landlords who weren't put out of business. So, if the judge let the plaintiffs look at Magners records and Magner was a billionaire what would that have to do with the above?

The judge won't let you go looking for something you aren't looking for.

Like I said from the begining there is nothing to these cases other than a bunch of wealthy property owners trying to intimidate City employees from doing their job.

It may suprise you to know Chuck that there have been several city employees who have given the landlords all the evidence they need and told them all of the places to look in the hopes that the corruption finally gets flushed out and they can do their jobs. I know some of these people Chuck and what I have heard on the QT is going to relaly suprise you I think. I can't wait to hear your response when this goes to trial and some of these things start coming out.

10:26 Some times I don't know why I try to explain these things but, one more time... These cases are in Federal Court as a RICO case, if somewhere along the way someone had evidence that Magner had killed someone and burried them in Lantry's backyard, it wouldn't have a thing to do with the RICO case, it would be a murder case and it would need to go to District Court not Federal court.

Same thing if someone was stealing something, that would have nothing to do with the Federal racketeering case. So, if the folks on here that claim that Magner stole crap from Nancy's garage were correct (but he is a billionaire from all the bribes he gets so one wonders why he needs to steal plywood...) it still wouldn't have anything to do with a racketeering case it would be theft and would need to go to District Court.

So, all this "inside info" you have if it doesn't help prove that there is a conspiracy of elected and appointed officials to try and shut certain landlords down for the benefit of PHA and/or other poperty owners its got nothing to do with tis case.

Landlords, I believe the city has made some mistakes from what I read here, however, a conspiracy no! None of you have proved that to me.

I did learn Maria Moermond should possibly wash her hair and Lantry has a big butt. Actually, nobody has even proven this.

All of you have really impressed me with your proof. You have been provided with a space here to state your claims and the best you throw at us is personal attacks on Miss Moermond and council woman Lantry, and even those statements have nothing to do with the rico suit.

Your attorneys are the only ones walking away from this with any money. Oh, I can't forget Mr. Johnson filling his pockets too.

Nifty position you have put yourself in Mr. Johnson. I was wondering how many candidates for city council have given you money to throw dirt so they could keep their hands clean.

Amanda, I have not spent any money donated to this blog on anything other than building participation here. I have not spent a single DIME on myself. In "FACT", I have SPENT my own money building participation here!I spent money on the Watchdog newspaper also.

IF, a candidate for city council had donated money I wouldn't tell YOU or ANYONE else.

I don't do this for money. I know you would like to paint that picture for folks who read here to attempt to discredit me. The fact is, I wish I didn't have to be the host of this forum it can be very unpleasant at times. I hear from a lot of distressed people.

I feel a civic responsibility to provide this space for the citizens of Saint Paul to air their grievances against the city.

Amanda, stick around and learn something about me before you make wild accusations about me. Do a search of this blog using the word "Racketeering" and research the information about the RICO suits before making wild comments stating the RICOs have no merit.

Have you even read the suits? They are linked to the right of the screen under the scales of justice.

This Amanda is a fool and Repke is a flat out mistaken.

Both of them would do their credibility some good to actually read the lawsuits so they are a little better versed on what it is about before going over the cliff with their misinforamtion.

After looking at the link to the lawsuits, it appears the city is being sued for a whole lot more than Chcuk wants us to believe. The following is what the city is being sued for:

OK 10:59 Counts 1,2,8,9 and 10 are the RICO case that the City has a conspiracy to put people out of business for the benefit of someone. PHA in one of the counts and unkown in the rest.

Counts 3-7 are the Civil Rights violations, I forgot those because they are so insane. They suggest that the reason why the City is going after the worse slum lords in the City is because the City is trying to get rid of the poor people in the City. Get it, the people who exploit the poor the worse slum lords are accusing the City who is trying to force these guys to keep their properties safe of trying to get rid of the poor. Balls the size of watermellons these guys have...

So, yes there are "ten counts" but they boil down to two meaningless accusations.

Government agents barging into private homes with no search warrant and against the wishes of the occupants is meaninless to you? Who's exploiting who Repke? St Paul bends over backwards to get these renters to call up and complain so they can go out there and help them supposedly, but when they get there they always seem to conveniently condemn the house if there are behavior issues, which have nothing to do with the house by the way. Now the family is living under a bridge or in a car and then the city demands a code compliance on the place which cost ten of thousands of dollars and does not need to be done! After they do it to enough places and tear down enough of them because the owners don't have the money to do the bogus repairs, then there is a shortage of places for those low income people to live. And then BINGO....all of a sudden the neighborhood is nice and white and no more problems. It looks to me like the city are the ones doing the exploiting of the poor.

10:51 and 10:57 here is the insanity of your arguements about 40% of the properties in Saint Paul are rental. About that same percentage are communities of color.

What you accuse the City of doing doesn't happen to 99% of the landlords or 99% of the tenants, so maybe, just maybe what we have here are landlords who don't take care of their propery and the City legitimately enforcing the code and unsafe buildings being not allowed to be rented until they are brought up to code.

That is the other alternative here folks. Because most landlords don't have these things happen to them.

Bob, I just realized that the title of this thread was changed. Didn't this first say something about Plaintiffs motion to see Magners records were denied?

Did you spin this thing to make a loss look like a win?

First you don't post it for three weeks and then once you do post it and people comment on what a loser the suit is, you change the title of the thread to make it sound like the Plaintiffs are pushing ahead instead of the Plaintiffs just got a big spanking.

This is the judge that allowed the Plaintiffs attorneys the ability to depose the former Mayor, two City Council Members and Marcia M and then watches the attornies decide the realy don't have any questions to ask them and now the same judge is saying you can't go poking around someone's tax records just for the fun of it.

Time to get a new lawyer Bob.

Tell me why Magner was allowed to steal from that garage? Why was he not prosecuted and punished. You don't want to really hear anyone except yourself.

Why haven't YOU went to the police and told them you have seen pictures or if you have not seen the pictures that they are available, of Magner stealing from a garage?

You have said many times if some wrong doing was done then he should be punished. Now do it.

Everyone knows this man has stolen goods from a garage. Now toddle off and act as a responsible citizen and find out why he has gotten away with this.

12:48 All I have ever seen was a picture of a pick up truck with plywood on it. I have no idea whose truck, where it was and where the plywood came from I have never seen a picture of Magner, anywhere... If you witnessed a crime, call the cops. Chuck gets to the point again. Seriously who the hell cares about what Magner did? From all I have read, it sounds like he was doing his job. I doubt if he was making any serious money on the side. Whatever little he may took in, good for him. That's the way the world works best.

And those city workers who have given info to the landlords, pray for them. Hopefully they will get what they deserve for ratting out their co-workers. Butt surfing is too good for them - being dragged behind a city truck until what little is left can be dropped off at their next of kin's residence is a fitting end.

Government agents entering homes for one purpose and being trained to look for illegal activity, and citizens who think the honest ones left amoung us should be dragged in back of a truck for telling the truth. Other citizens who think it is OK to punish and prosecute 3rd parties for other peoples behavior. And all the government groupies with no mind or courage of their own who stick up for this.....all the while hoping they will be the last ones to be eaten.Is this America? Wasn't this the way Saddam Husien treated people? Didn't his people act the same way hoping to save themselves and their loved ones? So many questions to get answered, but by who?

I speak of slumlords because, if I was to believe everything I read here, I still have examples right here on the east side of slum lords bitching about code enforcement and putting money up to keep this RICO farce going on. So, the only conclusion that one can draw is that these slum lords are representative of the plaintiff.

If you are concerned about civil rights violations then we do have a city attorney and Human Rights Commission and Department.

If they are not your cup of tea, I happen to know a couple of attorneys at the US Department of Justice over at the Civil Rights Division. I assure you, they don't give a damn about local politicians (or federal ones for that matter). They don't fuck around either with phony claims. There is a Fair Housing Initiative they're working on now (Home Sweet Home or something like that).

If you really think there are overt or covert constitutional housing violations going on- call them. They have already taken on Pennsylvania, Las Vegas, Tennessee, New York, Illinois and North Carolina in the last two years and won.

Now, if you really got a case and want to do something for real, there you go.

We all know that this is not about justice but, about trying to protect slum lords from being forced to take care of their property and mind the people the rent to.

Hi Eric. I have a long time friend who is a Human Rights Compliance Officer with the State of Minnesota.

When my son was beaten by the police I called him and asked him if I could file a complaint with his office.

He told me my son could file a complaint but, it would NOT go anywhere. He said the bureaucracy was in control. Then he went on to tell me exactly what the "Communities United Against Police Brutality" told me. Do not file a complaint with Internal Affairs of the police dept., or the Civilian Review Board. You know that board the NAACP sit on.

He said, your son could end up with a felony charge for filing a false complaint. Exactly the same advice I was given by CUAPB.

Eric, I am sorry your wonderful democrat system is seriously flawed from the state to the city.

Some people within power have taken great steps to minimize the voices of the people who most need our assistance.

We have people in power who feel they are going to do things their way no matter what. And the sorry thing about it is they are willing to violate citizens rights to achieve what they believe is good for all. They are well intended people who are destroying the fundamentals of our democracy.

I am a woman who rents a couple of houses that I bought for investment.

They both have been went though and made beautiful, I would have lived there my self.

Wilder Foundation Called me off an add and said they had a woman with a daughter and that daughter has a small child. They told me she was home less.

I rented to these people taking 150 a month less that I was asking. I am getting 550 a month for a 3 bedroom home. My payment is 950 to the bank. I lose each and ever month. Thanks to the fact that the market is fucked in St. Paul and no one wants to live there I am stuck with this house.

The woman is 3 months behind on her rent. Has several people living there that are not to be living there and she is doing no general care of the house, grass or yard. I am cutting the grass.

The building looks bad already and I want her out. Wilder is begging me to keep her and work with her due to the baby living in the home.

Code enforcement has been out twice this summer and I scurry around to do the requested items. I work all day at a job. Then I go to that property to clean up after the renters.

I think actually what you are Eric, is jealous without cause. You see I am the one suffering. I am the one who cares about the baby being homeless. I am the one that is doing this at a loss. Do you ever consider that landlords are good people? No, you just trash mouth slum lord this slum lord that.

I am so offended by your lack of fairness in all of this. You don't know everyone on this blog. You have no right to attack any of us with your slum lord name calling.

When I read your input on this blog, I see someone who never did anything but punch a time clock and make an hourly wage. You have never taken a chance to be come wealthy and you fear those who have taken a chance to better not only themselves but to give an opportunity to a family that would be homeless.

So we have three who have enough integrity to stand up and be named and we're supposed to be the cowards?

You'll notice that I referred to the Feds. Enough is enough. If there is corruption and discrimination in the housing area, then Justice has an entire division for you. They have taken on more corrupt cities like Chicago, Philadelphia, Vegas, etc- and won. OF course the city punish by lifting its ban and practices and having the feds oversee their policies and enforcement in relation to housing. In other words, you personally don't get your pockets fattened as you would say in a certain lawsuit pending.

Again, if you are serious, stop fucking around with a 'corrupt system' and rain on them from the top. Unless its as Chuck has pointed out over and over- much ado about nothing.

Bob, I'm a former civil rights commissioner and one of the things I learned is that there are people who enjoy the title, and other who are committed to the good. I am familiar with the current Human Rights Commission (not Department) and know that they are a committed group. For those who care, don't let the city or state remove more of their teeth from their findings (hence my suggestion that we all have a duty to stay informed and on top of what's going on beyond voting). A citizen commission with no power but to draw conclusions serve no one. CUAPB will agree with that.

And lastly, I have not threatened to beat anyone up who has not delivered the threat to me and even then, it wasn't a challenge on my part but an observation. Most of you on here sign 'Anonymous'. So will forgive those of us with names who tend to lump you all together. If you are not a slum lord- separate them from your group and then maybe more people will listen.

The reason we call our uniformed opinions fact is because of the many many people who are all saying the same things in sworn affidavits, lawsuits, sworn deposition testimony, Watchdog newspaper photographs, the 14 Jessmaine record, and testimony before the city council which a lot of us have watched with our own eyes and seen the results which were contrary to the weight of evidence presented.

We call the courts corrupt because there is evidence showing they are.

Here's more logic for you.
Every candidate running for council has publicly come out for tougher regulations on rental property owners- specific to duplexes and single family homes. They all seem to be doing well this year. Four years ago, they were elected with these views and worked to pass more strict codes with support from voters. So, one has to conclude that few people (I said there are a few)support these 'landlords'.

I've been to a lot of real town hall forums- the loudest applause comes from any statement talking about going after absentee landlords.

The only place in Saint Paul where you find opposition is right here- and the watchdog opinion mag. 300,000 residents and there are still only a couple of dozen at most, supporting your viewpoint. Oh, most of those have some skin in this game too.

Logic says its bullshit and every city employee can't be in cahoots to pull the wool over everyone's eyes. You'd have to believe the voters and citizens are stupid and you and your dozen friends are the only smart ones.

So which is it.

My property taxes have already shot up and I know that in order to meet the budget and maintain services we have to be prepared to feel the pinch again.

Didn't we learn our lesson on asking for more services without paying for it? We need more cops. We need more after school programs to give the good kids something to do besides hang out with the not so good kids. The city should also sponsor rehabilitation program better. The city needs to invest in areas that can grow with young families and entrepreneurs instead of them laying barren and dangerous. And, as a city we have to maintain our Park and Library system.

I am aware that those things cost money and am willing to pay my share to live in one of the last great cities where you can raise a family without being rich.

I also agree with Eric and I personally know about the lack of funding available for rehabilitation program from the meeting I had with the state department and my investors in regards to opening up a long term treatment facility that focused on female non-violent offenders with addiction and reuniting them with their children in a safe environment. We were told the program is exactly what is needed, but the funding to support programs of such was not available... so we are currently seeking other steps to proceed with our proposal for the facility.

Its a shame more people don't look at the future more rather than the present when it comes to the cost factor of rehabilitation.

Hi Eric, They aren't going after all renters. The city is targeting low income renters. Mostly minorities, mostly black. Mostly with behaviorial issues. You know this!

And of coarse to get rid of this protected class from these neighborhoods the affordable housing provided by private rental investors has to be depleted. And the city is doing a real good job at gentrifying our neighborhoods displacing minority and low income people, and using less than honorable tactics to relieve home owners of their property.

Eric, this is understandable. Most people who attend a block meeting or get involved in a neighborhood committee have issues with something that concerns them in their neighborhood. So they get involved. This is a very small segment of the population of the city. Most people do not have an interest or time to be civic-ally responsible. So what is left is a handful of citizens giving our elected officials input.

I say the input is swayed since at these neighborhood committees and block clubs issues of real crime prevention are not spoken about.

The direction citizens are shown is the blame game of shrugging responsibility from the city and police concerning social ills.

If people like me started attending these neighborhood meetings. The citizens would be asking WHY aren't the police doing their job. Jeeesh, we have citizens who fear calling the police for help. That is very telling of the climate that has been created by the policies you support Eric.

Unlike many, I do have options. I can move my family out of the city anytime I want. I choose to stay. Saint Paul is a great city and can be better. I like to think that there is still hope for some of the things I listed above in my 10:33 post.

Unlike you, I understand the Libertarians battle cry that there is no free lunch.

You want to complain about crime- but don't want your taxes to increase to pay for the necessary cops and programs needed to bring the crime rate down.
You think government is bad? Get off your ass and do something to make it better.

You can't back to the 1950's and even then things weren't great for everyone. Get up, get out and get informed but, don't bitch about the lack of certain city services and then complain about taxes. You show yourself to be the ignorant fool you are.

I would much prefer that the Police we have start enforcing the law instead of blaming everything on properties and landlords. I would much prefer that code inspectors start addressing code violations instead of behavior issues. That would be a good start. If you raised your children and never held them responsible for anything, do you think their behavior would get better or worse Eric? When we don't hold renters responsible for their behavior, isn't the same thing going to happen? Surely you are smart emough to figure this out, so why is it that you are always laying all the blame on the landlord who is usually more of a victim of the situation than a problem?

How many times do I have to tell you numbskulls?

I'm commenting on the RICO because I was insulted and brought into this. I was never involved in these discussions- why? Because I haven't read the depositions and am not as familiar with codes as say Chuck is. Now when Chuck brings evidence and backs up his posts AND refutes allegations with proof- yet he is still called a liar and tool. Someone even accused him of being on the taxpayers dole.

So as long as some see fit to call me names, assign motives to my ideas, once in a while threaten me, and just generally insult my common sense, I'm going to reply in-kind.

You can come to any of my meetings and say what you want. People do. I have heard the most racist, bigoted, ignorant, crazy stuff. I've also heard some of the most heartbreaking and hopelessness stories too. Its balanced with the good ideas, support, and unifying spirit that is present throughout the East Side. I have never worked to stifle discussion, debate of even arguments over here on the East side during our meetings. A little rowdy and raucous discussion is good for the forum sometimes. I also don't sit back like a lump and suffer fools well. So, yes, I am vocal and not one to back down. If the little old ladies can handle it, I'm sure you can. Many times than not, they handle me.

I do however, take every single request, complaint and inquiry and make sure it gets to the proper city reps, and bring back some kind of results or information the following month or as soon as possible. That's my record. Nobody can refute that factually.

As far what I look like? Why do you want to know? I'm married. My picture has been in a couple of papers recently. I assure you that I'm a tall dark handsome fellow with a captivating smile. I'm 6'2" 200lbs with a 35" inseam. You gonna buy me a suit too? I wear a size 12 shoes, just in case.

So, is this where I ask what do you look like and what are you wearing?

As far as who would come to a meeting that I lead, I'd say about thousands if you add it up over the years. I've talked to and listened to hundreds and hundreds of East Siders over the last few years.

That's why I'm confident that you all are on the wrong side of code enforcement. If you to talk about individual abuses, then you have an audience but, when you go on and on about a conspiracy that involves everyone who works for the city, county and judicial- then its bullshit.
