Patrons of Diva's Overtime Lounge, a North End bar that's been the site of several high-profile violent incidents, could learn sooner rather than later whether the city will shut it down.

The St. Paul City Council will hold a public hearing at 5:30 p.m. Wednesday to weigh its options on Diva's and owner Deb Johnson's alleged failure to maintain a safe business and comply with city requirements.

Two reports from administrative law judges backed the city's efforts to sanction the bar. The first lays out allegations involving rowdy behavior and city code violations, and the second concerns a delay in giving authorities access to a surveillance tape, which the judge ruled had been doctored.

Last year, separate shootings in or near Diva's left one dead and three injured.

Although the shootings won't be at issue Wednesday, Diva's has been sanctioned before and the council has the option to revoke the bar's liquor license, something city officials are already seeking through different channels.

You are right, a license is cannot be transferred. But there is a statute limiting the number of licenses St. Paul can issue. Highland has the fewest licenses of any area in St. Paul (they developed the area later than the rest of St. Paul) and the greatest demand for liceneses. So I am right too....

ergo, vis-a-vis, if a license gets revoked in one part of St. Paul, someone else can get the available license - and the money is on a joint in Highland, one that's probably owned by the Highland District Council or Hlegen (ok, I made that part up).

All of this time standing up for Diva's and we find out that she was not playing by the rules herself. She tried to hustle a city ran by hustlers.

Further, part of the tape was in color, part in black-and white, the judge wrote."

I too didn't know the whole story, probably my fault.

Rice Street has always had its working class toughs, as St. Bernards Church knows. Never has the city taken such an activist approach to get the goods on people and remove them when something happens. There are more realistic and practical ways to stay on top of the situation, than simply give people their walking papers. Approaching it this way also eliminates Rice Street at its best. I'd prefer Rice Street at its worst to the city's intolerance any day.

What is this about hiring Dawkins. He will work to advance himself, but don't expect anything resembling fair play and justice.

Council votes 6-0 to shut down bar over broken rules

After a yearlong battle between St. Paul City Hall and Diva's Overtime Lounge, a North End bar with a rowdy reputation, City Hall finally dropped the hammer Wednesday.

Citing the bar's history of flouting city rules and regulations, the City Council voted 6-0 to shut down the troubled bar - a vote met by loud applause from a mostly full council chambers. The move comes after a spate of 2006 violence linked to Diva's that rocked Rice Street and the surrounding neighborhood.

"We hear the community say, 'Enough is enough,' " said Council Member Lee Helgen, who represents the North End.

Dozens of North End residents showed up for the hearing, many of them members of St. Bernard's Church, a North End institution adjacent to Diva's. The Rev. Mike Anderson applauded the decision.

"Because of the impact that Diva's had, that had a negative effect on the neighborhood," Anderson said. "This just cast a pall over the neighborhood that nobody really had control over."

Several testified against the bar, including the mother of a St. Bernard's student who said Diva's contributed to neighborhood decline.

"A business should make a neighborhood stronger, not tear it down," said Kim Wilczyk, who lives in the area. "I shouldn't have to fear for my son's safety if he goes to a school dance."

The vote came despite owner Deb Johnson's efforts to clean up the bar's reputation, which many agree has been at least partly successful. For the most part, Diva's has receded from local headlines.

Andy Dawkins, a lawyer for Johnson, said the council's decision stands on weak footing.

"It's going to be the appellate court that decides (the issue), if she decides to take the appeal," Dawkins said. "I think she has a very strong case."

Dawkins and others have suggested that the bar is being targeted for its diverse clientele, something city officials have denied. Outside council chambers, Dawkins said the issue was decided because of "the politics of this room, when all the white people stood up."

The city yanked the license over a series of violations related to city codes and conditions attached to Diva's liquor license. The vote also means no bar can ever open again at that location, 1141 Rice St.

The council pulled the license for violating city regulations, not for the issue that drew many of the bar's opponents to the council chambers Wednesday evening: The bar has been the scene of numerous fights and at least two shootings, one of them fatal.

On July 14, 2006, Maurice Lovell Anderson, 26, opened fire in the bar, killing one and injuring two. Anderson was sentenced last month to nearly 27 years in prison. Months later, another man was shot outside the bar.

Diva's already was subject to a list of strict, city-imposed requirements. In addition to maintaining surveillance cameras, the bar also is required to hire security guards who have undergone criminal background checks, maintain a list of banned patrons and is barred from holding lingerie or bikini contests.

But a series of incidents ratcheted up the city's frustration with Diva's.

In addition to the violence, the city says Diva's installed a patio and kitchen equipment without permits. Police observed patrons drinking there after hours, leading to a September 2006 City Council decision to sanction the bar. The council ordered Diva's to close at 1 a.m. instead of 2 a.m. and pay about $3,300 in fines and court costs.

The latest episode was over access to the bar's security cameras.

Before Wednesday's vote, Johnson had some small successes in her battles with the city. A Ramsey County judge refused the city's request to have the bar declared a nuisance, a step toward shutting it down through the courts.

And a second administrative law judge rebuffed city efforts to shutter the bar following a four-day hearing, saying some problems could not be blamed on Diva's management. However, the judge did recommend a sanction.

But Assistant City Attorney Rachel Gunderson told the council Wednesday that Johnson has failed consistently to control her customers. In the 22 months before Diva's 2005 opening, Gunderson said, there were 43 police calls to the property. In the 22 months since, there have been 117.

"The patrons were running this bar, more than the bar owner," Gunderson told the council.

History Of Incidents

Since opening in 2005, Diva's Overtime Lounge has been the scene of numerous violent incidents. Some blame the bar, while some blame neighborhood decline in the Rice Street area. While things have quieted recently, here's a list of incidents taken from St. Paul police reports:

Nov. 20, 2005 - Police observe a street fight involving 60 people in front of Diva's. Nine officers responded to the scene.

Jan. 29, 2006 - Four intoxicated patrons get into a fight inside the bar. Two are cited for disorderly conduct.

Feb. 11, 2006 - Responding to a call of shots fired, officers find five shell casings on a sidewalk near the bar.

March 6, 2006 - Patrol officer sees three men fighting on the street outside the bar.

March 18, 2006 - Intoxicated patron punches out a bar window.

March 19, 2006 - Patron fights with Diva's bouncers, who had asked the patron to leave.

June 17, 2006 - A large group of people fight outside Diva's. One man loses some teeth, while an officer has beer poured down his back.

July 14, 2006 - One man slain and two others shot while inside Diva's.

Sept. 12, 2006 - Officers called to Diva's twice for fights involving the same individuals.

Nov. 11, 2006 - One man shot after exiting Diva's in the early morning hours. Police accuse the bar of not turning over surveillance tapes in a timely manner.

Right now I have enough funds to print enough literature to inform the public of your short comings and irresponsible in-mature behavior, to insure you do not return to the city council.

Count on the distribution of the "A Democracy News Letter" (you know that paper with all those nasty stories about you) 3 times over in your entire ward before the elections.

I pledge here and now this blog will be dedicated to your removal from the city council.

As the A Democracy war chest grows we will pick another city council member to unseat.

I am going to prove to this arrogant misguided leadership a grass roots community based forum can have an effect on a city election.

Helgen, your through! PROMISE!

I will take suggestions who we should put on the "unseat" list next should the funds become available.

Personally I'd like to see this whole bunch kicked out on their fannies. If you feel the same way I do, then donate some money to A Democracy. You can bet by 2012 this Town Hall Meeting will be heard loud and clear.

Printed literature and distribution isn't cheap. So donate whatever you can afford.

On another note- Anyone read the Community Reporter? There was an article about the up coming city council elections. The interviews with the most volume were Bill Dahn and Dave Thune. Folks, if you haven't read this get one! Bill out shines Dave in this article.

OK Bob, some basic campaign advice from and old political hack who has run a bunch of campaigns...

In Ward 2 you need to get some pro- Bill Dahn stuff out there if you expect him to make it through the primary. As you know, I am a Thune fan, but it looks like the big tobbacco money is coming to Fran Zamb. So, just blasting my friend David isn't going to get Bill through to the general. Four years ago the candidate who went dark on Dave and did a great hit piece finished fourth. She may have gotten people to not vote for Dave but they didn't vote for her.

So, hit pieces can take votes away from one candidate but in a five person race it doesn't make them move to you...

So, try thinking about good things to say about candidates you like rather than why you hate who is in office.

Its worked well for me for the last thirty five years.

Chuck, I don't need to do anything in ward 2 for Bill Dahn. I am not supporting any candidates!

I personally would vote for Melvin Carter because he acknowledges gentrification of our neighborhoods and is very concerned.You may find it interesting to learn many of the readers here are in favor of gentrification.

I will not push Carter or any other candidates on the participants here. Many here support people like Harris, Montgomery, and Bostrom.

The reputation I want for this Town Hall Meeting is "Accountability". The local media has dropped the ball on the controversial issues and has even gone as far as to LIE about the issues.

I want recognition for the common man this "Town Hall Meeting" can be leverage with the city council or ELSE!

What ever candidate benefits from this so be it.

This Town Hall Meeting is the "villagers up in arms" this is a new era of politics for Saint Paul Chuck. So, Chuck ya old political hack. Sit back and learn some new tricks for the common good of the public.

A crusty old man walks into the Repke non-profit office and says to the secretary, "I would like to donate this damn organization."

The astonished woman replies, "I beg your pardon, sir. I must have misunderstood you. What did you say?"

"Listen up, damn it. I said I want to donate to this damn organization!"

"I'm very sorry sir, but that kind of language is not tolerated in this organization."

The secretary leaves her desk and goes to Repke to inform him of her situation. Repke agrees that the secretary does not have to listen to that foul language.

They both return to her office and Repke asks the old geezer, "Sir, what seems to be the problem here?"

"There is no damn problem," the man says. "I just won $200 million bucks in the damn lottery and I want to donate to this damn organization to get rid of some of this damn money."

"I see," said Repke. "And is this bitch giving you a hard time?"

bob, i suggest you make the other canidates aware of your oust helgen campaign efforts if you haven't already done so.

I am retired, don't have a lot of money but i keep my home up the best i can. my wife and i are fearful of the stories we read about elderly people losing their home. something has to change.

when i first started reading this blog i didn't know whether to believe this stuff here or not. well that has changed. now, my wife and i are in shock.

my wife and i are grateful for this space, i know if i ever have problems with the city the people here will support me and my wife. this is a measure of comfort knowing people care.

you folks won't get my name. i can't afford a code compliance.

Hi All,

I'm sorry I have to go off topic. Scold me if you will.

Eric, I owe my patriotism to Rush Limbaugh. As you all know Rush is a conservative ICON. I first started listening to Rush in 88 when he started his program. Rush kindles the fires of patriotism with the hand of a finely skilled blacksmith.

As the years have gone by I have learned Rush is a master of communication in painting a brilliant picture for the Republican Party. But that is exactly what Rush does, he paints pictures for republicans under a conservative banner. Is Rush a true conservative. NO!

Al Franken is alot like Rush, only he paints pictures for the Democrats. And of coarse he isn't as talented. :-)

Both of these men would find it very difficult to add images of despair to their portraits of their party's.

Politics of today have gone to far to the right and left leaving us the masses, stuck in the middle with very few alternatives.

A lot of my beliefs could be misunderstood as liberal or progressive. I assure everyone I am very conservative. This isn't saying I am republican. I am a libertarian.

Here is an example in which I differ with my friends who think they are conservative.

I believe in preventive measures to crime and punishment over a mass prison population. When I speak of mentoring programs for at risk youth right wingers seem to think it is liberal jargon and we should just lock people up and punish them forever.Liberally spending money to keep these people locked up.

Talk about wasting tax payers money. Essentially what they are saying is let's spend a fortune on these habitual criminals over their life time, spread crime through relationships built in prison, verses spending money on the bottom end and mentoring and rehabilitating these criminals to be productive. Now, isn't this really a conservative value? We will save money help people become productive.

I recognize the drug war is a total failure. Cost us the tax payers billions to oppress our own people. The masses agree on this yet our government still oppresses us "liberally" with our own money.


The political jargon has rocked people from the core of common sense in this country. Divide and conquer. It is time we the citizens take back what is rightfully ours. "Government" that serves the interest of all it's people.
