what they don't tell people is they use behavioral issues to gain access to the home then they write it up with code violations to just get the people out of the house. it isn't really a safety issue with the house it is really an effort to get the tenants out of the property. to appease complaining neighbors.they even go as far as to lie about the condition of the house.

And then the unruley renters go to another neighborhood and start the same behavior all over again. So what's the answer? Declare the place a nusiance and tear it down, thus making the tax burden on the remaining neighbors a little bit higher.....and a little bit higher.....and a little bit higher every time they tear down a new one....until the people that are left cannot afford to stay in the house they have. They can't sell it either cause no one's buying. So now maybe the homeowner's can go live under the bridge with the same people they detest so much. Repke will bring "Meals on Wheels" every other day. On the off days, there's only one soloution......"EAT CAKE."

The administrative abilities are "0", and they may very well run the city into the ground.
Why can't they work with people?

They don't want to work with anyone. These people are too immature for that. They want to fight with everyone and screw everyone so they can assert the power and control they think makes them leaders. Watch em on TV, you'll see.

When something this big is this messed up, we get into chicken or the egg arguments. What came first?
I'll guess in this case, it starts with the legislative hearing officer.
The complexity of housing and contractor claims takes top notch people from the law, trades, or realty to figure out.
Hearing officer Marcia Moermond does not have this knowledge and cannot determine whether she is being lied to by city personnel. She turns to LIEP (or whatever it is called nowadays) for the answers. It ends up with bureaucrats regulating themselves. I also believe the hearing officer is two faced.
Add this to the amount of deadwood in the inspections department, some resentful and incompetent, and we get this mess. Lets replace this failed administrative system with a board of competent people not connected with the city.

OK Bob now that you opened up the topic of the RICO suits please explain why the attorneys for the property rights guys have decided not to question Randy Kelly, Dave Thune and Kathy Lantry.

I seem to remember this entire list screeming that this was a big deal that they were going to be deposed.

I guess not. There will be no questions asked to any of them. It was nothing but an effort to harras elected officials.

Hi Chuck & All,

I only have a rumour to offer.

I was told by a party who is not a plaintiff of the RICO suits, the plaintiffs recently developed information that made the depositions insignificant.

I don't know if this is a fact or not.

I personally do not believe these plaintiffs are spending thousands of dollars on a law suit just to have some funzies with the city officials in the form of a vendetta to harass. That is LUDACRIS!

With that I will let others discuss this with Chuck..

I think we should probably rename Chuck "City Bulldog".. :-)

They will be sending flowers when she is ushered out of city hall for the misdeeds that have happened. What a bunch of fools! They could have settled this a long time ago and blamed it on Kelly and Dawkons, but no they wanted to fight. It looks to me like the city is the ones doing the harrassing, not the landlords.

Anyone know any of these landlords? What kind of guys are they? I find it hard to believe there would be that many fools in 1 city that would spend the kind of money that lawsuits take just to "have fun" with the city. Do these guys seem like that stupid to the people that know them?

Look they have enough money to spend it on a little pay back at City Hall. They have the cash and they don't like being told what to do. They believe in the "Golden Rule"... He who has the Gold Rules...

The newest angle on the silliness is to go after the City for the information that was written in a staff report on problem properties back in 1992. In that report staff stated that a concern with any complaint based system was that it had the potential to be misused by racists to target neighbors they didn't like. The report cautioned vigilence on the behalf of the City to make sure that people weren't being harrassed.

You got it. Since the City actually was concerned about this and admits that it was something they were watching out for, the plaintiffs are now saying that is the reason for inforcement. No longer are we talking about the poor landlords who were victomized by the evil City with a desire to put them out of business. Now we have a new reason for the case, the City is trying to make itself white for fun and profit.

How is this a RICO case you might ask, since RICO cases are suppose to be about hurting one business for the benifit of another? You will love this, its to increase property values! The City will "profit" by the value of properties going up.

Come on kiddies at some point play time has to be done.

Chuck, the word is not "profit" it is "benefit" Read the law thinking in the terms of the way it is written. For a year and half now you have choosen to use the word "profit" and that takes the meaning of the law out of context.

Has the City "benefited" from displacing low income innocent people from their homes?

The answer to that is YES.

In my opinion Chuck the City has been harrassing the plaintiffs and their tennants.

It was the city that went to Court to try and hide from having their Depositions taken. If they have nothing to hide and have broken no laws, why not come and tell all and take credit for it in an election year? Aren't they proud of their work?

From what I hear from a source who is close to these guys is that back during the winter the landlords thought it was important to take the Depositions of these people because other Deponents gave a lot of incriminating information that backs up the landlords claims, and some of that info had to do with the City Council.

In the meantime while the Court took their time to ORDER the City Council to go and have their Depositions taken, the landlords investigation which is still on going turned up many "smoking guns" which not only incriminated council members, but also made taking their Depositions no longer necessary, thus saving the precious city resources you always say are being wasted by these guys.

You may also be interested to know Chuck that there are several people who work for the city that have been giving these guys all the proof they need by sending bundles of sensitive documents and emails through anonymous mailings to the Attorney's of the landlords.

Lets face it Chuck, you know what the city is doing and the bureaucrats know what they are doing. The City Council certainly knows what is going on so either these bureaucrats are not telling the truth to their Attorney or the city is the one harassing the landlords by trying to drag it out so long they run out of money. That seems to be one of their favorite tricks I hear.Only it is not going to work. Deep pocketed interest groups are watching.

Their all going to fall Chuck, and they're going to fall hard, and when they do, you my fair weather friend you are going to fall from their graces also because it will be a whole new crowd running the show, and you won't be part of it behind the scenes any longer.

I seem to remember an article in the paper that said that the city was going to buy some forclosed houses from a bank for 50 cents on the dollar. I'd say that's a profit. Let any common person go in and destroy a neighborhood with the tactics that the city used and then turn around and buy up the property for halfd price and see what happens.....they'd be in jail so quick it would make ytour head spin. Rico is about criminal and that is just what the city did with their inspections tactics.

This is not an issue about the class you think you have.
This is an issue where the city is destrtoying peoples lives and destroying their families.

Here we go again, there is double double secret information that the landlords have that has been snuck out of the basement of City Hall and just wait one of these days its going to come out... What a joke!

The reason why the council and former mayor didn't want to be deposed is that they had no relevant information to the case and the reason why the attorneys didn't ask them any questions was that they didn't want to be laughed out of court. There is no there, there.

Its a RICO case there has to be a conspisarcy and a benificiary... and there isn't either.

So, it doesn't matter if this guy or that guy is an ass, and doesn't matter if someone got a wild hare up their tush and unfairly treated this person or another. Someone has to benifit out of the deal for it to be a RICO case. At the end of the day that is what has to be shown to meet a RICO standard and an increase in property taxes or a the little bit of chump change that comes in fines isn't going to make this a RICO case.
