The silliness in this of course is that he is able to get away with it because the mortgage company has gone out of business. Once the assets of the mortgage company are assigned to someone, then that new owner of this mortgage will complete the foreclosure and get title to the property (title is currently in the hands of the homeowner who has walked away). Once the new mortgage company takes legal action, his time clock stops.

The other action that could kill this is if the current title owner gave him permission to stay in the house... denied that possession was adverse.... we bought a property for redevelopment and found that the neighbors garage was built partially on the land we bought so we filed papers giving them permission to have the garage there and denying them permission to rebuild in the future.... the garage stays but the potential claim of adverse possession goes away.

Claiming adverse possession isn't going to help him stay there once someone else asserts their legal right to the property. It only looks like he is winning because their is no one in the position to take action.

Sharon Anderson I have a question for you.

Back when you were having difficulty with your home at 1058 Summit, why didn't you just pay the property taxes and then file your lawsuit in Minnesota Tax Court instead of having them take away your property?

I see you spend a lot of time and expense fighting things after the fact, why don't you just take care of it in the first place.

I have actually read some of your briefs that you have submitted to the court and I just don't get it. What are you trying to do or accomplish? It seems like you are attacking your problems in a very backwards manner.

I have really tried to follow your posts and for the life of me I can't get past the first few sentences. You CC everyone under the sun, but you NEVER address YOUR actions or lack of I should say.

Sharon I just don't get it at all what you are trying to do. Help me out here, please explain yourself, and don't paste some garbage and CC the world, but lets have an honest conversation about what is really going on here.

So Sharon, if the taxes were paid, why didn't the courts take your home?

I dealt with the Ramsey County tax office when there was an oversite in not paying taxes on my property. I sent in the money and they sent me back a receipt and the story was closed.

I think the key issue with your house was you were given Five plus years to pay the taxes and you didn't and so the county took the most drastic step they want to do and that is take someone's property. It is no easy task to take someone's property. Lots of legal stuff involved. How simple would it have been to just pay the taxes.

Your posts are very difficult to read and understand. Can you please post in language we all can read.

Sharon, disabled or not, the law states that if you don't pay your property taxes, the government can take your property. If I remember correctly it takes five years of not paying your property taxes for the government to take your property. A taxpayer is given many opportunities to pay the taxes.

Then legal notice is sent to the property owner and as a very last resort the property is taken and put up for public auction. Again the property owner is given 6 months to reclaim the property after it is taken by the government.

All of this you didn't do. Disabled husband or not, if this was the case where did you come up with the money to fight this claim in court? Instead of fighting with the county, why didn't you just pay the taxes? If you couldn't pay the state has a program that enables the taxes to be put off until the property is sold. Many elderly homeowners are doing this because they can't pay the property taxes imposed upon our DFL city, county and state legislators. I believe Mike Paymar was the author of this legislation.

Sharon if they were PAID before the property was taken by the government please provide proof that they were.

If they were it would be the biggest story in Minnesota.

After doing some research this seems to NOT be the case. You decided not to pay the taxes and thus the state took your property. Ramsey County got it from the state and it was sold at auction.

The same thing happened to your car. You were given orders to comply with city code and when you failed to comply or appeal (hearing officer then city council) the city took action and towed away your car. I don't agree with what the city did and you have a valid argument, but the sad thing is the city is God and Kathy Lantry is mistress to that God.

But back to the topic on hand. Please show us you paid the taxes and any penalty before action by the state and then this will be a topic of discussion.
