ACLU Challenges Saint Paul Inspections Program.

Having been a renter I have a lot to say about this.

I just don't have the time to respond in detail right now. I'm going fishing.. :-)

I will say one or two things before I leave.

Ya know what would happen if a tenant refused entry to code inspectors. The landlord would not get his rental certificate renewed. There is a high probability the inspectors would just condemn the unit forcing the tenant out.

There is no way in hell a judge could side with a landlord under these circumstances and evict the tenant for not complying with a code inspection. So there would be no eviction. That sh.t is to deep for any Judge to tread on.

No rental certificate and the landlord once again is punished for something a tenant has done. In this case it would be someone standing up for their rights, and innocent people once again would be punished by a broken system.

I have asked a couple of landlords in the past to let me challenge this ordinance and deny entry to inspectors. They were to fearful, so out of concern for them I didn't make waves.

I personally don't need an inspector violating the private sanctity of my home. I am a highly skilled handyman and have always kept the rental I had in great shape.

St. Paul inspectors are a bad bunch, along with their support by the Not-So-Magnificent-7 City Council. The only valid concern is Health and Safety, not hidden agendas
Together they are destroying everything good about St. Paul

Little late there isn't much good about St.Paul left anyway, let the city and their officials have the town along with the vacant buildings/lots and they can sit back and watch the businesses leave the town also as they bang their heads together to figure out a way to get more taxes and revenue to give their developer associates/friends.

The Ramsey County judges do what the City & County tell them to do. I can't tell you the times I have been in Ramsey where the City & County Attorneys mistate the law, misrepresent the facts, and sometimes even outright lie about the case law and most of the judges just goes right along with them like they haven't got a brain in their head. In Ramsey they do what they want and what they are told to do with no respect to what the law says.

Hate to burst your bubble but there is no Santa.

No big news here. The ACLU has always been concerned that tenants get notices before inspections by the City. The City would maintain that it would be the responsibility of the landlord to give notice as to when they were letting the City in.

And, your wrong Bob any judge would support the land lord who said, the inspectors are coming next Thursday, clean up.

I am sorry Chuck, you misunderstood me.

What I was saying is no Judge would be fool hardy enough to violate someones fourth amendment rights and require a renter to allow inspectors into their dwelling.This would be the equivalent of a search warrant & a direct violation of the fourth amendment.

And the judge would also have no basis to evict the tenant if the landlord tried to evict them for not complying with the inspection.

Of coarse having seen this local judicial system in action anything is possible. But, there is hope that is going to change in the near future.

I have an open offer to any landlord who wouldn't mind me challenging this law. Rent me an apartment the month of your inspection and when the inspectors come to my door I will personally tell them where they can go!

THE FOURTH AMENDMENT

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

And what probable cause" would there be for the city to enter my apartment for their inspection?

If the city does not want to go into the person's home who is an owner to inspect it every year, then why would they want to go into the home of a renter.....it's the same home isn't it? This sounds like it would not be too hard to make an Federal "Equal Protection" case out of.

Hi All,

Having been a handyman and talking to "thousands" of renter's over the years, I happen to know that at least 9 out of 10 renters DO NOT want these code inspectors in their home. They feel it is a blatant invasion of their privacy.

Equivalent of having the Gestapo checking their living situation out. And folks, there is a hidden agenda to the code inspections. These inspectors are trained to look for evidence of illegal drugs. To me this is a illegal search and the tenant has no informed choice in the matter. They aren't informed of their fourth amendment rights either.

For many years I have known the fourth amendment can bring a grinding halt to these inspections. If any landlord out there takes me up on my offer I will prove it! I promise all proceeds from suing their arrogant behinds will go to building participation in the "A Democracy Town Hall Meeting", less legal fee's. :-)

And Chuck, you don't have to tell me the local ACLU is a sock puppet of the Democrat Party. I already know this. If a landlord takes me up on my offer and the City violates my rights or his, we will go to the ACLU first just to prove they are absolutely worthless to the citizens of Saint Paul.

The local ACLU sit's on it's butt while citizens of Saint Paul get screwed out their Civil Rights. Where were they when all those innocent people were condemned to the street by the City of Saint Paul rogue code enforcement?

Chuck, your pals over at the ACLU were only looking out for the City's butt, when they sent that notice out you know that.

It comes down to what are the rights of the owner vs what are the rights of the tenant and as we have watched in these discussions before, your side takes wild swings from one to another depending on which you think will slow the City's efforts to maintain safe buildings.

Bob, you now appear to agree with me that all the ACLU is saying that the tenant deserves reasonable notice before having to open the door to the land lord. What the City is doing with the inspections is telling the land lord that if you intend to be in the rental business in Saint Paul, for the safety of all of your renters we need to inspect the property on a regular basis, or you aren't allowed to be in the rental business.

Land lords have the right to inspect their properties that they lease to tenants to make sure they are not violating the condition of the lease that they take good care of the rented property. So, all the City wants is to go in there with the land lord.

No fourth amendment problem. They are their to inspect for public health and safety while the land lord makes sure that they are taking do care of the property.

Ah Yes....."Public Saftey"....one of the trusted stanbys of all time. Hitler led a whole generation of people into the furances with it and a whole country of people like the DFL bought into it because they were told they were going to be safer. By the way , they had a train too!

The city council's inspections will not get what it wants with this clumsy negative approach.

Leadership of the city is a balancing act, they will cause everything to fall down, and leave behind a lot of damage in the big picture.

It has been the Republicans that have led us to a safer country by spying on us, locking us up indefinitly, over riding the constitution, lying under oath, pushing us into war, leaving our borders wide open, suspending liberties with something called the Patriot Act, and just like Germany, a Department of Security for the Homeland.

I'm starting to think that some of you are as dumb as you post to be.
