City Counsel deemed arbitrary and capricious

Link the title of this topic for a case a few years back in which the City Counsel was deemed by the court to be "arbitrary & capricious" concerning an investors property.

Some of it is legal boredom, weave through it and the meat of the story is real interesting.

Only 1 year left to go and hopefuly they will get the same thing Randy Kelly got at election time.

I also have read this completely; what it does prove is that the city and its officials produce one sided documents to make their decision on what should be done with someones home, and they got caught at this one. The problem is they still continue and are getting away with it over and over again!

Arbitrary = uninformed, illogical

Capricious = unreliable, fickle, erratic, variable, changeable

I'm from West Virgina so i'm not aware of who sits on your city counsel.

This case seems to be a number of years old. Have the counsel members changed since then?

What is important here is that the procedures have not changed, they have gotten worse.

I can't wait to see the mess they are in next year. Should be interesting if some of these questions come up when they are running for election again. I cannot imagine that their opponents will not try and use some of this stuff with as much of a stink as people are making of it. A lot of these issues have been around since the beginning of the year, and that makes me think they are not going to go away any time soon. I wonder what they would do if all of sudden all kinds of people started suing them?

The meat of the story seems to be frighteningly close to the allegations being made by everyone else about the City of St. Paul.
