Assembly candidate goes to court to get slogan on ballot "not the 'whiteman's bitch'

Madison — Independent Assembly candidate Ieshuh Griffin filed a federal writ of habeas corpus Thursday in an effort to put the phrase "not the 'whiteman's bitch'" on the ballot under her name this fall.

The filing in U.S. District Court in Milwaukee came a day after the state Government Accountability Board could not garner the votes to put the phrase on the ballot. Under state law, independent candidates are allowed to place statements of principle of up to five words on the ballot to tell voters what they stand for.

Staff for the board struck the phrase from the ballot because they deemed it pejorative. The board on Wednesday voted 3-2 to allow it on the ballot - one vote shy of the four needed.

Griffin promised Wednesday to file a lawsuit against the board, and on Thursday she submitted her paperwork in federal court.

"They have unlawfully held my liberty in their custody," she said Thursday.

Griffin is running to replace retiring Rep. Annette Polly Williams (D-Milwaukee). Three Democrats are running in the Sept. 14 primary, and the winner will face Griffin Nov. 2.

Griffin said she wanted the phrase on the ballot because it would show that she will fight the status quo.

"I'm saying the average politician rolls over to the system and I'm not that politician," she said.

Griffin did not pay the $5 filing fee, and the court must first determine whether the case can proceed without payment.

The case has been assigned to U.S. District Judge Rudolph T. Randa.
