Saint Paul/ UPDATE on Nancy Lazaryans battles with the City of Saint Paul

A summary for new readers. Nancy has been having issues with the City of Saint Paul over a home at 1033 Colne. Nancy attempted to perform a citizens arrest on a high ranking city official for not doing his job concerning issues with this home. She was charged with assault and found guilty in court. She is appealing the decision and having difficulty getting the public defenders office to represent her.

The issue of the home at 1033 Colne is coming before the city council this upcoming week.

56. Appeal of Nancy Lazaryan, on behalf of Evelyn Wallace, to a Summary Abatement Order for property at 1033 Colne Street. (Legislative Hearing Officer recommends denying the appeal)

Nancy's is the last issue on the council agenda. The council must have put her up last so she could educate ALL the other citizens who go in before her. :-) Actually I was thinking they may have put her up last so they could use their gestapo to rough her up when nobody else was around. I'm sure she will have the cameras rolling for this deal.

Remember when I mentioned on the blog that the Court of Appeals, district court and state public defender’s office were having hissy fits and not wanting to represent me on my appeal?

I had submitted the attached “Motion to Appoint Counsel” to the Court of Appeals. (I also personally mailed a copy to each Justice of the MN Supreme Court).

Chief Judge Touissant ordered that Judge VanDeNorth consider my motion.

VanDeNorth ordered that the Ramsey County Public Defender handle my appeal, and for the state public defender to reconsider the denying of them taking on my appeal.

I then called the Chief Ramsey County Public Defender (Jim Hankes) and he told me that he and the state public defender were going to APPEAL the order of VanDeNorth.

I waited for the notice of appeal…never got it.

So I went to Judge VanDeNorth’s chambers last week and asked to have a hearing date set up so that I could charge the Ramsey County Public Defender and the state public defender with contempt of court.

In the alternative I asked for an ex-parte evidentiary hearing to determine if there was probable cause for me to do a Citizen’s arrest for misconduct in office of these public employees.

Sure, Nancys issue is a sensative one and the Council doesn't want others before her on the agenda getting a wiff of whats really going on.

Bob was right to.

There will be police waiting outside the door so when they provolk nancy, she would go off
( so the council would hope ) and nail her on a probation violation related to her case with Van Denorth.

I wonder how many other defendants got shafted by the public defenders office and the courts ?

Its interesting how both the courts and public defenders office seem to believe they don't have to represent indigent defendants,
but the higher court has upheld
the long standng duty of representation for indigent defendants.

Just like judges who sentence defendants to jail are aware of the prispn population and some times give defendants less time in jail then the guidelines suggest, these judges are also aware of the budget constraints concerning monies for public defence.

That is no excuse since the United States Supreme Court has ruled that indigent defendants have a right to representation.

Blame your legislators also since they appropriate the money and in Minnesota, have run us into the ground.

Legislators should take a pay cut so we will have the money for Public Defence.

Let tell you people. That this stuff happened many times to other people of St.Paul. And they do not get lawyer to help them.

Because the City of St.Paul funds
the Public Defender. And they had
a conflict of interest. The State
Of Mn should be the only one to fund The public Defenders. At
fair budget.

I feel that Nancy will not get fair shake from them.

The city of St.Paul is doing illegal activities and they know it. When comes to code enforcement. They been told by
the stat supreme court have told
them. And they are doing business as usually.

Nancy should get the appeal on her property. Katy L. is upset with her.

The whole city council should be remove for violation of State Laws and cause of loss of personal property. Declare war on Landlord and Homeowners that do not have money to fix up their proprety.

They forgot that they need to stop
crime. And increase business.
Too reduce the taxes on its people.

The city council would spend as much time code enforcement on crime.

We would not have two shooting and
killing. In frogtown, or else where.

But put the blame on the landlords.
Put blame on the right people.
Make people responsible for their own actions.

No, the City does not fund the Ramsey County Public Defenders Office. Ramsey County may continue to provide some funding support (like Hennepin County did -- largely due to labor contracts), but the majority of the office's funding comes from the State of Minnesota.

And, Ramsey County is losing 12 positions due to reductions in state funding per the 6/21 edition of the Pioneer Press.

I'm sorry to hear of Nancy's status as an indigent person. Under Minnesota Statutes 611.17:

(a) Each judicial district must screen requests for representation by the district public
defender. A defendant is financially unable to obtain counsel if:
(1) the defendant, or any dependent of the defendant who resides in the same household as
the defendant, receives means-tested governmental benefits; or
(2) the defendant, through any combination of liquid assets and current income, would be
unable to pay the reasonable costs charged by private counsel in that judicial district for a defense
of the same matter.
(b) Upon a request for the appointment of counsel, the court shall make appropriate inquiry
into the financial circumstances of the applicant, who shall submit a financial statement under
oath or affirmation setting forth the applicant's assets and liabilities, including the value of any
real property owned by the applicant, whether homestead or otherwise, less the amount of any
encumbrances on the real property, the source or sources of income, and any other information
required by the court. The applicant shall be under a continuing duty while represented by a
public defender to disclose any changes in the applicant's financial circumstances that might
be relevant to the applicant's eligibility for a public defender.


I assume that the "financial statement under oath or affirmation" would be a document that anyone could request under the Data Privacy Act. Does anyone know for sure?

You are starting the see the problem with Nancy. She is unable to follow through on simple request or procedures and is ready to fight the law.
That's admirable at times but, pretty damn stupid when you need something from them. Just like with the dumpster, just follow through and then fight. Her daughter is in the situation she is in BECAUSE of her mother's inability to follow through without feeling like she's being slighted. She takes a mudhill and makes a shit mountain out of it and then bitches about everything being shitty.

Nancy, if you want a public defender, do like everybody else has to do and follow the procedures. Or, stop bitching.

You give us more proof of level of intellect the city is defending itself against with one hand tied behind its back.

The Public Defenders Office IS funded through the state. It was taken out of the county's hands back in the late 80's. It was NEVER under the responsiblity of the city.

Kathy Lantry has risen to President of the city council. She wipes the floor up with every single challenger. After Chris Coleman, she will probably be our Mayor. She is popular and has a record that people like and respect. Chasing slumlords out of town is not going to loose her any points with hardly anyone except the landlords that have left town or never lived here anyway. She's civicly involved across the city and has the ability to raise a lot of money.
How is her career over again?

You think that when your Watchdog Rag starts to attack her, that other well-funded Independent Groups won't run Public Relations campaigns painting you landlords as slumlords who brought blight and slum to the city? Of course they will. It'll be a million dollar effort and you can't compete with that.

I am tired of this Journer's nasty comments and using facts to try to show how Bub is wrong and Nancy L. is poor. I believe these people are on God's mission to root out the evil-doers just like George W Bush. Bush new their were Wepons of Mess Destruction and went and got it done.

Nancy L. is like a blond Michelle Bachmann who is on a mission for husband and God. I bet she's got some money but won't let the government know so she gets a free lawyer. She deserves a free lawyer with all shes gone through. I hope the public defender is good and will listen to Nancy tell him what to do and how to do it.

And Bob is like my other hero Mac Hammond who uses the bully pulpit to tell us how to think and waht to believe in and vote for.

I think Soujurner is just another DFLer lawyer who has to much education and to little smarts. Readers here are to smart to fall for his facts! We know whats what and all these facts give to us to make us more confused.

Dear Judge Lindman,

Pursuant to your Order from the bench on June 26, 2008, I had the dumpster removed (that same day) from the property at 1033 Colne.

I clearly heard you say that you were staying the enforcement of the registered vacant building (as to occupancy). But, the City of St. Paul is pursuing boarding up the house, and there is a public hearing on Wednesday (July 2) concerning the boarding of the house.

May I please get a copy of the transcript with your order from the bench, or if you have time, the written order to stay the enforcement of the vacant building (before the St. Paul city council meeting on July 2, 2008)? Evidently, the City does not take seriously your order from the bench. Maybe something in writing would make the City comply with your order.

I was at a hearing on June 24, 2008 before the St. Paul Legislative Hearing Officer concerning the boarding of the house. Before it was my turn, many other people appeared whose homes had been condemned by the City because these people were unable to pay their electric bills. The city officials had literally thrown these people out into the streets and seized the houses because the electricity had been cut off.

Please review our pleadings in this case. The City purports that because the owner of 1033 Colne had voluntarily suspended the utilities to the house, the house qualified as “unfit for human habitation” and thereby met the criteria as a “vacant building”. This does not comply with the state code, or with Morris v. Sax.

Also please note the names of the Plaintiffs. We are bringing this action as private attorney generals on behalf of “Other Similarly Situated Persons.” Many, many people have spoken at the St. Paul city council meetings and demanded the City comply with the restraints of Morris v. Sax. But the City refuses and they are throwing people out of their homes by condemnation that does NOT comply with the directives of the state building code.

These “Other Similarly Situated Persons” need YOUR help.

The district court is the proper forum to seek the necessary relief to stop the destruction of people’s lives by the City. As you may know, I went back and forth with Chief Judge Touissant
when I attempted to appeal Judge Higgs “unappealable” order. IT IS CLEAR that the Court of Appeals wants a complete record to be made, as the appellate court is not the proper court to be the trier of facts in these local issues.

Patrick Tierney, attorney-at-bar has now been hired to represent the interests of my mother, Evelyn Wallace.

Would you allow me to speak on behalf of the “Other Similarly Situated Persons” as a private attorney general and seek equitable relief from this court in the form of a restraining order that keeps the City from kicking people out of their homes and condemning and demolishing houses based upon a city code that is in violation of Morris v. Sax?

If not, would you allow Patrick Tierney to bring said motion for equitable relief?
